Lexington Board of Health Meeting, November 10, 2008 at 7:00 p.m.

Health Department Attendee: Gerard F. Cody
Heiger-Bernays called the meeting to order at 7:00 p.m.
Minutes from the last meeting were not available.
Boston Sports Club – Camp Lex – Gerard Cody stated that representatives from Boston
Sports Club are before the Board due to serious issues regarding the permitting process
for Camp Lex who have been in Lexington since 2006. According to Cody, Ms. Fox has
been dealing with them and there has been repeated problems with obtaining complete
applications. Cody stated that during the past 2008 season, Camp Lex failed to provide
the following information to Ms. Fox at the Health Department:
Certificates of Inspection from the Building Dept.

CORI and SORI reports for all staff (as of 7/30/08, only 8 CORI Reports

were provided)
Failed to provide immunization certificates for the camp staff
??
Failed to provide immunization certificates for the campers

Cody then gave Boston Sports Club an opportunity to speak to these issues and any other
issues relevant to this evenings meeting. Emily Colton of BSC stated that the only
documents on the list that was not provided to Ms. Fox before the end of the camp season
were the Cori and Sori reports. Ms. Colton said Fox stopped in the beginning of August
the Cori and Sori are not kept at the Club and must be requested from the HR department.
She requested them and then sent Fox an email saying she had all the results Cody
requested, that CORI, SORI and immumization certificate information be faxed to the
Health Dept. for any additional staff hired after the issuance of the permit. Cody also
requested that the Health Dept. receive a note indicating the number of new campers and
confirming proper immunization certificates. After a discussion, Perlmutter motioned
that Camp Lex/BSC submit all required applications, CORI checks, immunization
certificates any other required documents by June 15, 2009 to the Health Dept. and
Camp Lex/BSC will be denied an annual permit to operate a camp at this location if it
fails to submit a completed application and all other required documents by June 15,
2009. MacKenzie seconded. All approved.
Lemon Grass Update – Cody informed the Board that Lemon Grass will be presenting an
update this evening and perhaps after hearing what progress has been made, there could
be a consideration to close the case with a few stipulations. Maureen Lee, advised that
Lemon Grass has finished all of the on-site audits. Lee stated that the last audit found no
violations on her part and a recent Health Dept. inspection showed no violations. In
terms of the plan review and updating the facility, Lee said the landlord has not made a
decision concerning the property as to what space will be available. If the landlord has
not made a decision by December, an alternative plan would be to use the existing space
and bring it into compliance. Lee also stated that audits and on-site training will be
conducted every 60 days. Cody mentioned that the plan review is the only outstanding
issue from the original order.
19 Garfield Street – Hearing
Tenant and relative to the owner of 19 Garfield, Arthur Linelli, appeared before the

Board of Health to provide an update regarding the order letter dated September 30 and
to provide a basis as to why this dwelling should not be declared unfit for human
habitation and a condemnation order issued.
After much discussion, Sharon MacKenzie motioned that “The Lexington Board of
Health has ordered that the occupants (including tenants and owners) must schedule a
housing inspection of 19 Garfield with the Health Director, Health Agent, Fire Inspector,
Plumbing Inspector, Electrical Inspector and Building Inspector within 10 days of this
hearing. You will be required to attend the next Board of Health meeting scheduled for

December 8, 2008 at 7:30 PM to continue this hearing. If you fail to schedule an
appointment with this inspectional team, then this home will be declared unfit for human
habitation and a condemnation order will be issued.” Perlmutter seconded. All
approved.
Tobacco Regulation
Mr. Cody outlined to the board the steps that have been taken to review the existing
Tobacco Regulation. Various documents, including a proposed revised regulation were
distributed to the Board for review. It was decided that a hearing would take place at the
next Board of Health meeting.
EP update

Mr. Cody informed the Board that an EDS drill took place on Saturday November 1,
2008. In addition to testing the plan and engaging over 40 MRC volunteers, there were
568 adults and 137 children vaccinated against influenza. A total of 743 vaccines were
dispensed over a two-hour period at Cary Hall.
