HomeMy WebLinkAbout2007-04-24 CONCOM-min MINUTES -LEXINGTON CONSERVATION COMMISSION April 24, 2007 Commissioners present: Stewart Kennedy, Angela Frick, Philip Hamilton, and David Langseth Absent: Richard Wolk, Duke Bitsko, and Joyce Miller Others present: Karen Mullins, Administrator, Adam Bossi, Administrative Assistant, and Louise Vinci, Department Clerk Phil Hamilton, Vice Chair, opened the meeting at 7:15 p.m. in Room G -15, Town Office Building. 7:15 p.m. Continued Meeting: RDA, 286 Lincoln Street, Arlex Oil Attorney Ed Grant gave a brief update of what had occurred since last meeting. Arlex Owner, David Eagle and Chris Tomoula, MHF Designs Engineer met with Karen Mullins last week and submitted Engineer's letter, licensed site professional letter and revised plans. Chris Tomoula outlined changes to drainage system, which included adding trench drain piped to stormceptor and installing high point along driving access. Commissions comments followed: David Langseth asked about the diameter size of the trench drain. Mr. Langseth also asked about contamination test results. Mr. Tomoula responded by saying that the test showed contamination above standards only in the area where the old pumps were contained, and that the amount of contamination in that area had lessened through their past and present remediation efforts. Stew Kennedy asked for follow up on contamination tests in the future. Mr. Corey, Licensed Site Professional hired by Arlex, responded that testing would be performed under the on -going DEP review. Gloria McMeninmen of 264 Lincoln Street asked about canopy runoff and where it goes. Jeff Malloy Epsilon's Wetlands Consultant replied they would use a gutter type system and runoff would travel into a catch basin. Mark McGuire of 249 Lincoln Street expressed concerns about the increased potential of off -site contamination caused by the amount of traffic that would come from an increase in business due to the fact that where there was once one business, there would now be three businesses. Mr. Tomoula responded that the drainage system is designed to treat storm water runoff to remove TSS and petroleum hydrocarbons in accordance with standards. Mr. Maguire asked how much contamination is acceptable? Phil Hamilton answered; that the Conservation Commission had to act within their regulations and Arlex had met stormwater management standards. Angela Frick wanted to be ensured that gasoline runoff would not go into Vine Brook. Mr. Tomoula went over the proposed drainage system again for her. The Commission asked Ms. Mullins to incorporate the following conditions into the Determination of Applicability: MINUTES - LEXINGTON CONSERVATION COMMISSION Page 2 MEETING DATE: April 24, 2007 • Submit spill containment plan to Commission for review and approval. • The Zurn catch basin shall be fitted with an oil /gas hood (if possible) • Monitor contamination and submit test results on a regular basis. If test results identify that it is feasible to infiltrate storm water, applicant /owner shall take steps to implement infiltration system. Motion made and seconded to issue negative determination with conditions stated above, 4 -0 in favor. 7:54 p.m. Hearin: NOI, 481 Marrett Road, Mike Flamang, Lexington Town Engineer, presented proposed plan. Mr. Flamang states that at the present time the water levels at the reservoir dam cannot be regulated, and as a result water is backing up against the dam. The proposal involves cutting and replacing pipe, putting in a manhole with new control valves, and installing a new outlet. Work will commence as soon as possible. Stew Kennedy asked what the existing pipe was made of and how much the project might cost. Mr. Flamang answered that the old pipe was steel and because the steps proposed were not labor intensive it would not be very expensive. Mr. Kennedy asked if the bike path would be disturbed and for how long. Mr. Flamang responded it would only be closed only for a short time during the first part of project and for only a day or two after. David Langseth suggested requiring the following conditions: installation of additional erosion controls per the administrator's request, submit more details about the rip -rap apron, and that the dam be left undisturbed and all work be done from down slope. Motion made and seconded to close hearing, 4 -0 in favor. 8:07 p.m. Continued Hearin: NOI, 9 Village Circle, R. and R. Hines addition and driveway (201 -704). Motion made and seconded to continue to May 8, 2007 at the request of the applicant's representative, 4 -0 in favor. 8:08 P.M. Hearin: NOI, 177 Grove Street, Phil Hamilton opened the hearing by reading the legal notice. Steven Erickson, Norse Environmental, presented plans for a three -lot cluster development with two driveways including plans to control surface runoff rate per bylaw rules. Angela Frick commented that in the proposed plans some trees would be removed and she was concerned about how this would affect the water table. Mr. Erickson responded by saying that it should have little affect because although in the summer a tree might go through 5 or 6 hundred gallons of water a day in the spring and winter months there is very little transpiration. Ms. Frick also mentioned that she was concerned about the runoff breaking out at the surface onto Dewey Rd. during her site visit. Mr. Erickson answered by stating that this project would not impact that area of the property and they would keep as many trees as possible. Ms. Frick asked how they planned to protect the abutters' property if the course of runoff changed. Mr. Erickson replied that they would be using catch basins to collect runoff from the Dewey Road driveway. Mr. MINUTES - LEXINGTON CONSERVATION COMMISSION Page 3 MEETING DATE: April 24, 2007 Hamilton asked for more information concerning their drainage plan, including showing roof down spout connections, foundation drains and sump pumps. Mr. Erickson responded that that would have 6 " -12" crushed stone under cellar floor with pipes running through it and on the outside PVC piping running towards the lower spots of the property. At this time Mr. Erickson commented that technically the houses were not under the jurisdiction of the commission. Mr. Langseth responded by saying that if Mr. Erickson read the commissions bylaw he would see that this development is under the jurisdiction of the commission. Mr. Hamilton stated that the Commission would be retaining an engineer to provide an independent review of the drainage system to assure the Commission that water runoff will not change or cause flooding off -site or to wetland resources. Mr. Langseth also mentioned that he had many questions about the stormwater management system and drainage plans but didn't want to go into them now, and if it was okay with the applicant, he would submit comments to the independent engineer performing the review. Mr. Erickson agreed that this was acceptable. At this time, Mr. Hamilton opened the floor up to questions from the audience. Fred Martin 29 Dewey Road read a letter dated 4 -24 -07 that was submitted into the record. William Leavitt is concerned about the character of the neighborhood and is against cutting down many trees. Al Salvato of 3 Gould Road commented that to preserve the trees on his property, he built his house around them. He also asked for the square footage of the homes proposed. Mr. Erickson answered they would be 3850 square feet, 3400 square feet and 3730 square feet. Beth Mazer 27 Dewey Road was concerned about runoff, would like to see smaller homes and more trees preserved. John Frankouich 19 Dewey Road concerned that the new buildings will change the flow of runoff and he will receive more runoff on his property as a result. Ms. Frick asked why the driveways would be 18 ft. across, was concerned about that much impervious material and would like to see them smaller. Mr. Erickson explained that the Fire Department required 18 ft. wide driveway for shared driveways, but 4 of the 18 ft. would be made with paver stones, and the Grove Street driveway would remain the same width as presently because it is a single driveway. Motion made and seconded to continue for four weeks to May 22 for the commission to obtain the services of an engineer to review the drainage, 4 -0 in favor. 8:48 p.m. Continued Hearin: NOI, 24 Inileside Road, W and K Martin, addition (201 -703) Motion made and seconded to continue to May 8, 2007 at 8:30 at the request of the applicant's representative, 4 -0 in favor. 9:00 P.M.
