Present: Acting Chair,. Arthur Smith, Nyles Barnert, Maura Sheehan, John McWeeney and Associate
John Gilbert sitting in for Judith Uhrig.
Petition Address: 18 Hickory Street
The Chairman opened the hearing at 7:45 PM by reading the legal notice and described information
received from the Petitioner, other Boards and Commissions relative to the Petition. There were 5
letters of support submitted with the petition.
Subhash C. Gupta, owner of the property, presented the Petition.
The relief sought is for a Variance in accordance with Zoning By -law section 135 -35 to allow relief
from front and side set backs.
The hardship is with the placement of the house on the lot a variance is needed for proposed additions.
Questions from the Board:
Mrs. Sheehan: Are there wetlands in the back? Answer: Not usually any standing water. A little wet
right now with weather as it's been.
Questions from the audience: None
Speakers in favor — Mr. Ron Gold, abutter was present and in favor of the project saying that he would
be the neighbor most effected by project. He thought that Mr. Gupta's addition would be very tasteful
and would be an enhancement to neighborhood.

Decision: On a Motion by Mr. Nyles Barnert and seconded by Mr. John Gilbert, the Board by vote of 5-
0, granted the variance to allow a 24'6" front setback and a 10' /z foot side setback at 18 Hickory Street.

Petition Address: 16 Hayden Avenue
The Chairman opened the hearing at 7:54 PM by reading the notice and described information received
from the Petitioner, other Boards and Commissions relative to the Petition.
Larry Smith, owner of the building, presented the Petition. Also present at the hearing was co -owner
Michael Martenelli. Mr. Smith explained how the provision for the extra parking spaces was set up in
the original plan. Typically they have 8 -12 cars parked on Hayden Avenue at least two days a week
when the Medical Center has clinics opened.
The relief sought is a request to construct 12 parking spaces referenced in the Preliminary Site
Development and Use plan dated August 21, 1997. The plan originally called for 13 spaces and they
are asking for 12 so that they can angle the spaces.
Questions from the Board:
Mr. Smith: Where are they planning on putting the snow? Answer: They usually truck it off site.
The pictures of the parked cars are what happens now along Hayden Avenue? Answer: Yes, there are
anywhere from 8 to 12 cars parked along Hayden Avenue during clinic days.
Mr. Barnert: Will there be employees or patients using these spaces. Answer: Patients, employees are
requested to park in the under ground garage.

Decision: On a Motion by Mr. McWeeney seconded by Mr. Barnert the Board by voted by a vote of 5 -0
to approve the additional 12 parking spaces as referenced in the Preliminary Site Development and Use
plan dated August 21, 1997.

Petition Address — 50 Robbins Road
The Chairman opened the continued hearing at 8:02PM by reading the notice and described information
received from the Petitioner, other Boards and Commissions relative to the Petition. There were 5
letters of support received with petition.
Greg Rapp, Owner and Architect, presented the Petition.
The relief sought is for a variance to allow them to extend front entry 6 feet, which would result in a 22-
foot front set back.
The hardship is caused by the position of the house on the property. The house is situated well to the
front and left of the property.
Questions /Comments from the Board:
Mr. Barnert verified that a 15.5 setback to the steps is what he is looking for.
Mr. McWeeney: What is status of street? Answer: It is an unaccepted street that the town plows.

Decision: On a Motion by Mr. Barnert, seconded by Mr. Smith, the Board by vote of 5 -0 unanimously
granted the variance to allow a 15.5 feet setback.

Petition Address: 29 Tucker Avenue
The Chairman opened the hearing at 8:08PM by reading the notice and described information received
from the Petitioner. There were no comments from any Boards and Commissions relative to the
Petition. Two Letters of support were received from abutters.
Mr. Ron Pounder, owners, presented the Petition.
The relief sought is to allow a 28 -foot front and an 8.6 -foot side variance.
The hardship is due to the location of the non - conforming house on the lot.
Questions /Comments from the Board:
Mr. Barnert: Where would the garage door be? Answer: There will be no garage; addition is taking the
place of the garage.
Mrs. Sheehan: Are you staying within the current footprints in back? Answer: Yes
Mr. McWeeney: Set back okay on the other side? Answer: Yes, there is nothing on the other side.

Decision: On a Motion by Mr. McWeeney, seconded by Mr. Barnert, the Board by a vote of 5 -0
approved the petition for a 28 -foot front and 8.6 -foot back variance for 29 Tucker Avenue.

Petition Address: 482 Bedford Street
The Chairman opened the hearing at 8:20 PM by reading the notice and described information received
from the Petitioner. There were comments from the Boards and Commissions relative to the petition.
Boards commenting were the Conservation, Planning and from the Zoning Enforcement Officer.
Atty. William Dailey, Jr., presented petition. Also present from Children's Hospital was Peter
McManus and Dan Gillis.
The relief sought is for a minor revision to a special permit to allow the addition of 440 square feet of
storage space. This storage space would not be used for patient care.
Questions /Comments from the Board:
Mr. Barnert: Internal access only? Answer: Yes
Mr. McWeeney: Is the exterior finish going to be the same as the building? Answer: Yes
Mr. McWeeney: What is the metal storage trailer on the lot there for? Answer: It was a temporary
construction trailer that has been removed from the site already.
Mrs. Sheehan: Why would this be a minor revision? Answer: Because of the small footage, no
increase in staff or parking.

Decision:
On a Motion by Mr. Barnert and seconded by Mr. Gilbert, the Board of Appeals by a vote of 5 -0
approved the minor revision to allow the addition of 440 square feet of storage space.
