Petition Address: 35 Bernard Street
The relief sought is for a Variance from Section 135 -35, Table 2, Dimensional Control to allow a
front set back of 26.1 -feet instead of the required 30 -feet to change the configuration of the front
stairs.
The Chairman opened the hearing at 7:45 PM by reading the legal notice and described
information received from the petitioner relative to the petition.
Prior to the hearing, the petition and supporting data were reviewed by the Building
Commissioner, Conservation Administrator, Town Engineer, Health Director, Zoning
Enforcement Officer, Planning Board and Selectmen's Office. Comments were received from
the Conservation Administrator letting the applicant know they needed to file with the
Conservation Commission regarding this project.
Xiaojin Xiong, owner of the property, presented the petition.
The Board had questions regarding the hardship and the legality of the shed in the backyard. The
petitioner explained the shed was there when they bought the property and will check the
dimensions and set back.
There were no questions from the audience.
No one spoke in favor or in opposition of the petition.
Hearing was closed at 7:56
Discussion: The majority of the board felt the project was consistent with the neighborhood and
the hardship was clear because the house had to be built forward towards the street because of
the wetlands in the rear of the lot.
On a motion by Nyles Barnert and seconded by Leo McSweeney the board voted 5 -0 to GRANT
the VARIANCE to allow a front set back of 26.1 -feet instead of the required 30 -feet to change
the configuration of the front stairs.

The relief sought is for a Special Permit with site plan review to allow construction of an
extended stay facility by Westin Hotels approved by the2006 Annual Lexington Town Meeting.
The Chairman opened the hearing by reading a letter from Attorney John Farrington,
representing Starwood Lexington Realty, requesting the application to be postponed until the
August 10, 2006 meeting.
On a motion by Nyles Barnert and seconded by Leo McSweeney, the Board voted 5 -0 accept the
postponement until August 10, 2006.
