Wilson, John J. McWeeney, David G. Williams, Martha C. Wood and Associate Member Edward D. McCarthy Staff Present: Dianne Cornaro, Administrative Clerk and David George, Zoning Administrator Petition Address: 27 Vinebrook Road, Map 48, Lot 68 Petitioner submitted the following information with the application: nature and justification of request; topographic plan; plot plan; letter from David George to applicant dated June 13, 2012 and letters of support from abutters at 3 Sherburne Road and 25 Vinebrook Road. Prior to the hearing, the petition and supporting data were reviewed by the Building Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Zoning Administrator, the Planning Director and the Historic Districts Commission Clerk. Comments were received from the Conservation Administrator and the Zoning Administrator. The Chairman opened the hearing at 7:30 pm by reading the legal notice and described information received from the petitioner. Richard Ashton, owner of the property, presented the petition. The petitioner is requesting a Variance in accordance with the Lexington Zoning By- Law section 135-39B (1) (a) to allow a fence to be a maximum height of 7 ft. 6 inches instead of the required 6 ft. maximum height allowed. At the hearing the applicant presented pictures of the site to the Board. There were no Board questions. There were no questions from the audience. No one spoke in support or in opposition of the petition. The hearing was closed at 7:38 pm. During discussion one of the Board members commented that she does not like to vote for something that has already been done but since the abutters agreed to this she will vote in favor of the petition. McCarthy Staff Present: Dianne Cornaro, Administrative Clerk and David George, Zoning Administrator Address: 33 Marrett Road, Map 31, Lot 63B and 64 Petitioner submitted the following information with the application: nature and justification of request, topographic plan, plot plan, floor plans, site lighting plan, landscaping plan and a copy of a special permit dated October 5, 1971. Prior to the hearing, the petition and supporting data were reviewed by the Building Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Zoning Administrator, the Planning Director and the Historic Districts Commission Clerk. Comments were received from the Enginering, the Conservation Administrator, the Historic Districts Clerk and the Zoning Administrator. The applicant is requestinga SPECIAL PERMIT AND MODIFICATION OF A SPECIAL PERMIT in accordance with the Zoning By-Law (Chapter 135 of the Code of Lexington) section 135-69 to amend parking requirements and to amend a special permit previously granted to accommodate new parking spaces. Gerard Frank of BFE Architects presented the application for the Supreme Council of Ancient Scottish Rite Free Masonry. Also present at the hearing was John McNaughton and Steve Polliti of the Supreme Council and Civil Engineer Robert Carter of HW Moore. Mr. Frank presented to the Board the existing condition and the proposed changes to the parking lot. The Board questioned the lighting and the landscape plan which Robert Carter explained in detail. The Board also asked how late the lights would be on, (7:30 pm) how tall the poles were (12 ft.), how many poles would there be (8) and when the trees would be moved (In the fall). BOA Meeting August 9, 2012 4 The Board also discussed with the applicant not limiting themselves to using the parking for employees only so that it would be available for extra parking for Museum events. The applicant replied that they would consider the option of having the lot remain open for the Museum on weekends and after hours. Linda Napier of 46 Marrett Road questioned how many spaces there would be. Linda and Warren Napier of 46 Marrett Road said the Supreme Council have been good neighbors and spoke in favor of the petition. No one spoke in opposition. The hearing was closed at 7:54 pm. On a motion by John J. McWeeney and seconded by Edward D. McCarthy, the Board voted 5-0 to grant a SPECIAL PERMIT AND MODIFICATION OF A SPECIAL PERMIT in accordance with the Zoning By-Law (Chapter 135 of the Code of Lexington) section 135-69 to amend parking requirements and to amend a special permit previously granted to accommodate new parking spaces.
