Kanter Shirley Stolz CAPITAL EXPENDITURES COMMITTEE REPORT TO 2009 STM (MAY 6, 2009) Warrant Article Analyses and Recommendations Article 4: Appropriatefor Funds Requested Funding Source Committee Recommendation $85 General Fund Cash) Approve (5 -0) Lowell Street Unknown, if any (Free Indefinite Postponement Clarke School I 1 (s -o) 1 S prinkler S stem "In the process of renovating the heating system at the Clarke School in 2008, Fire Department staff observed that the previous replacement of ceiling- mounted univents from 2000 were obstructing the sprinkler system spray pattern at various locations in the building. It has been determined that this configuration of sprinkler heads does not meet code, including the code requirements for the new univents. Sprinkler coverage needs to be increased to reach beyond the univents. Adding and /or relocating sprinkler heads will accomplish this requirement." Article 6: Land Purchase —Off Funds Requested Funding Source Committee Recommendation Unknown Community Pending Community Lowell Street Preservation Fund Preservation Committee (CPF) (TBD) (CPC) Decision "To see if the Town will vote to authorize the Selectmen to purchase or otherwise acquire, or to take by eminent domain for recreation, affordable housing, open space or other municipal purposes, any fee, easement, or other interest in all or any part of land shown as lots 38, 40A and 43 on Assessors' Property Map 20, now or formerly of Busa..." [Town of Lexington Warrant to the 2009 STM, May 6, 2009] CAPITAL EXPENDITURES COMMITTEE REPORT TO 2009 STM (MAY 6, 2009) Article 7- Appropriatefor Funds Requested Funding Source Committee Recommendation $25,000 CPF (Cash) Approve (5 -0) Community Preservation Committee Administrative Expenses (FY2009) "To see if the Town will vote to amend the vote passed under Article 9(r) of the 2008 Annual Town Meeting to increase the amount appropriated for administrative expenses of the Community Preservation Committee... "DESCRIPTION: This article requests additional funds to cover unanticipated administrative and legal costs incurred by the Community Preservation Committee during the current fiscal year (FY2009)." [Town of Lexington Warrant to the 2009 STM, May 6, 2009] "In FY '09, the Committee budgeted $50,000 for its administrative costs. Midway through the fiscal year, however, the CPC's three day a week Administrative Assistant moved to a full time position within the Town, but in another department. In an effort to attract and retain qualified staff, the part -time CPA position was combined with a part -time position supporting the offices of the Town Manager and Finance Department, resulting in one full -time benefit- eligible position. The CPC's pro -rated share of these benefits was not reflected in the original administrative budget of $50,000. It is estimated that $8,000 in additional funds is needed to cover this cost. "The CPC also anticipates that it will exceed its estimate for legal fees in FY '09. This is due in part to the necessary legal review of CPC articles for three town meetings that will have been held this fiscal year: the November 2008 Special Town Meeting, the 2009 Annual Town Meeting, and the May 2009 Special Town Meeting, and to the periodic legal services related to previously authorized projects. For these reasons, the anticipated overrun in the CPC budget due to legal fees is estimated at $16,500. "The CPC also anticipates miscellaneous overruns for legal advertisements, printing costs and supplies. This anticipated overrun is projected at $500." [Community Preservation Committee Report on Article 7, Apr 23, 2009] This Committee concurs that the CPC needed, and will continue to need, the increased, fully qualified, administrative support provided by their Administrative Assistant so that the CPC can continue to deal with, and properly vet, the large number of diverse projects that have, and are likely to continue to, come before it. Having had that increased support led to a better presentation of projects to the 2009 Annual Town Meeting and this 2009 STM which enhances the debate at Town Meeting for the significant amount of the funding from our taxpayers represented by the CPC requests. We also fully support funding for both the known legal and miscellaneous expenses and a reasonable allowance for those projected expenses through the end of this fiscal year. 2
