<br />Article xx Tree By-law <br />(Place holder) <br /> <br />To see if the Town will vote to amend the Tree By-law by: <br /> <br />- removing section 120-4.B of the bylaw that currently excludes sites under other <br />jurisdictions <br />- <br />for larger sites, providing for a larger fraction of the site protected by the bylaw. <br /> <br />DESCRIPTION: <br />Sites under the jurisdiction of the Planning Board, Conservation Commission and the <br />Zoning Board of Appeals are currently excluding from the Tree Bylaw. This change <br />would remove that exclusion. <br /> <br />The current bylaw applies only to the setback areas (30 ft in front, 15 feet for the sides <br />and back). For single family residential sites this makes sense. However, for large <br />residential or commercial developments, a much smaller fraction of the site is covered <br />(The larger the site the smaller the fraction of the site to which the bylaw applies). <br /> <br />Consider, for example: <br /> <br />100' x 100' site: 61% covered by the bylaw: <br />200' x 200' site: 34% <br />400' x 400' site: 18% <br /> <br />The change will correct this inequity by increasing the fraction of the site covered for <br />larger sites. <br />
