PLANNING BOARD MINUTES <br />MEETING OF MAY 6, 2002 <br />The meeting of the Lexington Planning Board held in Room 119, Clarke Middle School, was called to <br />order at 7:05 p.m. by Chairman Galaitsis with members Davies, Harden and planning staff McCall - Taylor <br />present. Mr. Kastorf and Ms. Chase were absent. <br />* * * * * * * * * * * * * * * * * * * * * * * * * ** MINUTES *** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** <br />Review of Minutes The Board began to review and correct meeting minutes. They postponed final <br />action until the next meeting to allow a more complete review. <br />* * * * * * * * * * ** ADMINISTRATION OF LAND DEVELOPMENT REGULATIONS * * * * * * * * * * * ** <br />UNACCEPTED STREETS <br />Park Drive, Request to Certify as Public Way — Mr. Julian Bussgang sent a letter to the Town Clerk with <br />a copy to the Planning Board asking that Park Drive be certified as a public way. Ms. McCall - Taylor <br />explained that Park Drive was a non- street and was listed as such on the Planning Board document "Non - <br />Streets That Do Not Appear On The Zoning Map ". She had done some research in department files and <br />had found that it had that status in 1966; as far back as she had found records. The Board did not wish to <br />get into a full title search and history of the lot at this time but asked that Mr. Bill Leahy, town counsel, be <br />asked to give an opinion of the status of the documents including the deed cited by Mr. Bussgang. <br />* * * * * * * * * * * * * * * * * * * * * * ** ARTICLES FOR 2002 TOWN MEETING <br />Article 20, House Impact Review, Possible Move to Reconsider Mr. Galaitsis reportedthat he had talked <br />with Mrs. Jacquelyn Davison over the weekend and she had told him she would not move for <br />reconsideration of Article 20 without the backing of the Planning Board. Members said that they had no <br />reason to change their stand against reconsideration unless new material was available. Ms. McCall - <br />Taylor said that she had spoken with Ryan Pace of Palmer and Dodge and that he felt that the appeal <br />process had been explained at Town Meeting, would not be new information and, therefore, not a basis <br />for reconsideration. <br />COMPREHENSIVE PLANNING <br />Transportation Element, Draft Request for Proposals: Drafts of the Request for Proposals for the <br />Transportation Element of the Comprehensive Plan were distributed. Members were asked to review the <br />document and return any comments as soon as possible. The goal is to have the document approved at <br />the next meeting on May 8. <br />RECOMMENDATIONS ON APPLICATIONS TO THE BOARD OF APPEALS <br />Applications To Be Heard on May 9, 2002 <br />Farm Road, south end _ The Board discussed the application for a variance from the minimum frontage <br />requirements. It was their understanding that case law does not allow the granting of such variances and <br />that the recommendation that they had sent to the Board of Appeals on December 18, 2001, when this <br />issue was first before the Board of Appeals, was still valid. The Board felt that if the legal issues were <br />resolved to allow a variance they would favor a plan that would not allow further subdivision of the lot. <br />Mr. Davies recommended that the Planning Board have no comment on the following applications: <br />8 Eastern Avenue — Variance from front yard setback to construct a new front entry <br />11 Ledgelawn Avenue — Variance from 2.5 story limit to add a story which will be three stories in <br />back and Special Permit to construct addition above nonconforming portion of single - family <br />dwelling. <br />
