OVS MORN,^,G <br /> Off` OP <br /> a �w PUBLIC MEETING MINUTES <br /> Conservation Commission <br /> rxc'j°� <br /> L£x <br /> APRIL Meering broadcasted by LexMedia� <br /> AGENDA Monday,March 29, 2021, 6:30 p.m. <br /> Pursuant to Governor Baker's March 12, 2020 Order Suspending Certain Provisions of <br /> the Open Meeting Law, G.L. c. 30A, §18, and the Governor's March 15, 2020 and <br /> subsequent Orders imposing strict limitation on the number of people that may gather in <br /> one place, this meeting of the Lexington Conservation Commission will be conducted <br /> via remote participation to the greatest extent possible. No in-person attendance of <br /> members of the public will be permitted, but every effort will be made to ensure that the <br /> public can adequately access the proceedings in real time, via technological means. In <br /> the event that we are unable to do so, despite best efforts, we will post on the Town of <br /> Lexington website or through LexMedia an audio or video recording, transcript, or other <br /> comprehensive record of proceedings as soon as possible after the meeting. <br /> This Conservation Commission meeting was held remotely via Zoom, an online meeting <br /> platform. Public Participation via calling in or using your computer was encouraged. <br /> Commissioners Present: Philip Hamilton, David Langseth, Duke Bitsko, Alex Dohan, Kevin <br /> Beuttell, Ruth Ladd and Holly Samuels <br /> Staff Present: Karen Mullins, Conservation Director and Meghan McNamara, Department <br /> Assistant <br /> 6:30 PM New Business/Pendine Matters <br /> Request for Enforcement Action at 180 East Emerson Rd by abutter Mr. and Mrs. Chen, 184 <br /> East Emerson Road; DEP4201-1047, BL# 1004 <br /> Attorney Susan Bernstein and Mr. Kyle Burchard, PE,presented to members of the Commission <br /> on behalf of Mr. and Mrs. Chen, property owners of 184 East Emerson Road. Mr. Burchard <br /> presented the discrepancies he found between the approved Amendment to the Order of <br /> Conditions and the submitted as-built including: difference in spot shots and existing grade <br /> contours, various areas of increased grade in the backyard where the infiltration system is placed <br /> and around the side yard of 184 East Emerson Road, and an additional rise on the front side of <br /> the house. Attorney Bernstein is concerned that the changes made to 180 East Emerson Road <br /> have caused significant flooding and pooling of water on her client's property. <br /> Ms. Mullins informed Attorney Bernstein and Mr. Burchard that the Order of Conditions has not <br /> expired because of the tolled Order, and that she is organizing a site visit with the property <br /> owners of 180 East Emerson Road and will reconvene when more information is available from <br /> the Certificate of Compliance request and site visit. <br /> 1 <br />
