Members present were Commissioners <br /> 6Vilbur n•I. Jaquith, Chairman, Philip B. Parsons, Secretary, Ruth G. <br /> .Bevan, George E. Graves and R~ax H. Straw. <br /> The Chairman reviewed the factual background pertaining to the ap- <br /> plics.tions of Rowe Ghevrolet, Inc. and Depositors Trust Company for <br /> certificates of appropriateness for the erection, maintenance and dis- <br /> play of signs on the tops of taxicabs owned and operated by the Lexing- <br /> ton Cab Co., Inc. It was explained that the facts presented at the <br /> hearing showed that signcards had been purchased by the two applicants <br /> at a cost of approximately X100 each for a contract period expiring in <br /> September, 1969 and that the applicants paid a monthly advertising charge <br /> one-half of which was paid by the advertising agent to the taxicab <br /> company. Also, it was pointed out that the Lexington Cab Co., Inc. had <br /> fastened bolts through the roofs of the taxicabs and that there would be <br /> some expenses incurred b y the taxicab company in restoring the tops to <br /> a serviceable condition upon removal of the carrying units. Considera- <br /> tion also wa.s given to the issue raised at the hearing that taxicabs <br /> located in the Battle Green District in the past had displayed adver- <br /> tising panels on the rear of the taxicabs without having had certifi- <br /> cates of appropriateness. <br /> After discussion, upon motion duly made and seconded, it was <br /> unanimously <br /> VOTED; That the Commission determines that the erection, <br /> maintenance and display of the signs involved in <br /> the application of Rowe Chevrolet, Inc. on the tops <br /> of taxicabs owned by the Lexington Cab Co., Inc. <br /> and located within the Battle Green District would <br /> result in signs having a style, design, and colors <br /> and locations which would be inappropriate for the <br /> Battle Green District and which therefore would be <br /> contrary to the purposes of the Historic Districts <br /> Act. <br /> Following the foregoing determination the Commission considered whether <br /> owing to conditions especially affecting the signs but not affecting <br /> the Battle Green District generally, f ailure to approve the application i, <br /> would involve a substantial hardship to the applicant and whether such <br /> application may be approved without substantial detriment to the public <br /> welfare and without substantial derogation from .the intent and purposes <br /> of the Act. Thereupon, upon motions duly made and seconded, it was <br /> un an imou s ly <br /> VOTED; That the Corrnnission determines: 1. that failure to <br /> approve the Rowe Chevrolet, Inc. application to the <br /> <br />
