PLANNING BOARD MINUTES <br />MEETING OF FEBRUARY 2, 1987 <br />The meeting of the Lexington Planning Board held in Room G-15, Town Office Build- <br />ing, was called to order at 7:32 p.m. by the Chairman, Mrs. Uhrig, with members <br />Cripps, Klauminzer, Sorensen, Wood, Planning Director Bowyer, and Assistant Planner <br />Rawski present. <br />********************* ADMINISTRATION OF LAND DEVELOPMENT REGULATIONS ************* <br />PLANS NOT REQUIRING APPROVAL UNDER THE SUBDIVISION CONTROL LAW <br />36. Land at 12-18 Hartwell Avenue: Mr. Bowyer explained that MICO Realty had <br />submitted a plan which showed no change in lot lines. Apparently they are attempt- <br />ing to secure the three year freeze from a change in use if a Form A is approved <br />prior to a zoning amendment. He suggested that the Board not endorse the plan that <br />has the same language as an "Approval Not Required Plan" under Chapter 41, Section <br />81P but indicate it would sign the plan under the provisions of Section 81-X which <br />deals with the confirmation of existing lot lines. Mr. Sorensen pointed out Sec- <br />tion 81-P says that endorsement cannot be withheld. It was agreed to seek the <br />advice of Town Counsel. <br />37. Form A/86-16, Lowell Street: Mr. Bowyer pointed out that in the previous <br />meeting, a brief motion to rescind its earlier endorsement of this plan was voted. <br />' In this case, a more detailed motion explaining more fully the action of the Board <br />appeared advisable. On the motion of Mrs. Wood, seconded by Mrs. Klauminzer, it <br />was voted 3-2, with Mr. Cripps and Mr. Sorensen in the negative: <br />That the action of the Planning Board taken on Ausust 4, 1986 to endorse the <br />plan entitled "Birchknoll Terrace" dated 7/24/86 prepared by Bethel, Duncan & <br />Associates, Inc, Burlington, Mass., certified by David A. Duncan, professional <br />engineer, is hereby rescinded because the plan that was filed in the Middlesex <br />South Registry of Deeds is not the same plan that the Planning Board endorsed <br />because changes were made in'that plan after it left the custody of the Board <br />and without the Board's knowledge or consent. <br />SUBDIVISION OF LAND <br />38. Busa Farms, Preliminary Plan: The Board reviewed a draft of a favorable <br />decision on the application for a preliminary plan. Ms. Rawski suggested a change <br />to show that the plan submitted met the requirements of the Mass. Subdivision <br />Control Law only and did not comply with the Development Regulations. Mr. Sorensen <br />suggested that the Planning Board require that the right-of-way be extended to the <br />property line so that it can be extended later. Mrs. Klauminzer suggested that the <br />Board require that the definitive plan be submitted in compliance with the Develop- <br />ment Regulations. On the motion of Mr. Sorensen, seconded by Mrs. Klauminzer, it <br />was voted unanimously to approve the preliminary plan for the Busa Farms subdivison <br />with the amendments to the decision and with the addition of a fourth condition <br />requiring compliance with the submission requirements of the Development <br />Regulations. <br />
