PLANNING BOARD MINUTES <br />MEETING OF FEBRUARY 14, 1983 <br />The meeting of the Lexington Planning Board, held in Room G-15, Town Offices, was <br />called to order at 7:03 p.m. by the Chairman, Mrs. Smith, with members Nichols, <br />Sandy, Sorensen, Uhrig, and Planning Director Bowyer present. <br />ARTICLES FOR SPECIAL TOWN MEETING <br />26. Article 2 -- Conversion of Muzzey School: Mr. Bowyer reported on a conversa- <br />tion with Kirk Noyes, the designated developer for Muzzey, relative to four sug- <br />gestions contained in the Planning Board's report. Point 1 -- Noyes said that not <br />more than 30% of the dwelling units could be offered at the "pre -sold" price be- <br />cause those are "give away" prices, below the basic financial structure of the <br />proposal. Point 2 -- Noyes agrees that a preference should be offered to the <br />applicants who meet the August, 1982, income guidelines. Point 3 -- Noyes agrees <br />in concept with discouraging the deferral of purchases to avoid deed restrictions. <br />The particulars on matters such as the time period and the percentage of the sales <br />price that the Town would receive on unrestricted units, needs to be worked out; he <br />thinks somewhere between 12 and 15 percent is reasonable. Point 4 -- Noyes sug- <br />gests modifying the definition of "completion of construction" as the completion of <br />all public interior space, all exterior site work and the issuance of the first <br />occupancy permit. <br />Mr. Sandy inquired what would happen if an income qualified person purchased a unit <br />and then rented it to non -qualifying persons. Mrs. Smith thought there would be a <br />' provision in the condominium agreement to control rentals. <br />On the motion of Mrs. Nichols, seconded by Mrs. Uhrig, it was voted 4-1, with Mr. <br />Sandy opposed, to approve and sign the report and recommendation to the Town Meet- <br />ing. Mr. Sandy explained that he voted against the recommendation because he does <br />not think negotiations have gone far enough, too much is left to the Board of <br />Selectmen, providing a maximum of 30% of the units at the "pre -sold" price was not <br />acceptable, and the question of rental to non -income qualifying persons was still <br />open. <br />Gail Colwell, Chairman, and Ellie Klauminzer, member of the Housing Needs Advisory <br />Committee were present. Mrs. Colwell reported that she had contacted all members <br />of the committee except one and they had agreed to support the Planning Board <br />report and were in favor of pursuing the four suggestions in further negotiations. <br />The Board reviewed a memorandum, "Addition of LexHAB Concept to the Muzzey Article" <br />from Chairman Smith, and an outline of a proposal for a Lexington Housing Assist- <br />ance Board. Mrs. Smith explained that she wanted the Board to be aware that the <br />LexHAB proposal would be included in the Muzzey article. Mr. Sorensen commented <br />that there was too little information to take a position. Mrs. Nichols commented <br />that while she favors the concept of a housing assistance board to aid in the de- <br />livery of affordable housing, she doesn't know enough about the proposal to support <br />it at this time. <br />1 <br />
