PLANNING BOARD MEETING <br />April 3, 1978 <br />The meeting of the Lexington Planning Board was called to order at 7:09 p.m. <br />by the vice chairman Dr. Friedman with members Wheaton, Sandy, Nichols, <br />planning director Briggs and Secretary Mrs. Snow present. Mr. Zabin joined <br />the meeting at 7:15 p.m. <br />Allen Griggs of Boston Edison's Transmission Construction Division, and WOODPARK EST. <br />John J. Bartley, Principal Right -of -Way Engr., were present to state con- <br />cerns about lack of progress by A. J. Lane Construction Corp in removal of <br />a hill in Woodpark Estates subdivision relative to installation of power <br />lines. Mr. Griggs recapped Planning Board, Conservation Comm. and Edison <br />decisions on developer Lane's May 1977 request for permission to lower the <br />hill upon which Edison construction is to take place, and stated that no <br />alteration of the hill will be allowed after the May 15th energizing of <br />the lines. Mr. Lane's illegal removal of fill from the subdivision (Aug. <br />1977) and subsequent letters and memos dealing with correction of the <br />violation were referred to. <br />At 7:25 p.m., Mr. Lane joined the meeting to show existing and proposed <br />contour, and drainage plans of the area in question. He was informed <br />by Chairman Zabin that he must either lower the hill as permitted and <br />under conditions imposed regarding placement of fill removed, or fill in <br />previous excavations for poles to allow Edison to proceed with its <br />scheduled construction. Mr. Lane was reminded of prohibition of removal <br />of fill from the subdivision site without Board of Appeals permit. Res- <br />ponsibilities regarding the earth moving process will be stated in a <br />letter to be written to Mr. Lane, with a copy to Mr. Griggs. Section 39 <br />of the Zoning By -Law and applicable Rules and Regulations of the Planning <br />Board will accompany the letter. Mr. Lane plans to apply for subdivision <br />approval on three lots in Woodpark subdivision which will have grading <br />changes as a result of alteration of the hill. <br />The Board reviewed a plan submitted with Application Form A78-7, showing FORM A78-7 <br />land at Somerset Rd. Lot B -1B is to be combined with adjoining Lot A -lb SOMERSET RD. <br />as shown on the plan. Upon a motion duly made and seconded, it was EMERY <br />unanimously VOTED: <br />The plan entitled "Subdivision Plan of Land in Lexington, Massachusetts" <br />dated November 11, 1977, by Phillips & Chatel Assoc., submitted with <br />Application Form A78-7 on March 29, 1978, by Wilbur M. Jaquith, Esq., <br />for George W. and Marjorie S. Emery, showing land at Somerset Rd., re- <br />quires no approval under the Subdivision Control Law. <br />The vote was conditional upon addition of a notation "Lot A -lc is not a <br />buildable lot. The Planning Director was empowered to endorse the plan <br />on behalf of the Board following addition of the notation. <br />At 7:53 p.m., upon a motion duly made and seconded, it was unanimously EXEC.SESSION <br />VOTED: <br />To go into executive session for discussion of matters of litigation, <br />the disclosure of which could adversely affect the financial interests <br />of the Town. <br />It was also unanimously voted not to resume open session following the <br />close of executive session at 7:59 p.m. o. 1A0 <br />AU <br />Iris G.
