1 <br />1 <br />Monday, August 27,1951 <br />Present: Adams, Caouette, Irwin, Johnson, Potter, Ripley <br />Meeting opened at 7:45 p.m. <br />Paper Developments <br />Letter received from Mr. Stevens in reply to query as to whether <br />subdivision control provisions effective in the town would apply to land <br />recorded in Registry of Deeds but which has remained a "paper street" in <br />that no lots have been sold and no ways laid. It was the opinion of the <br />Board that the last paragraph of the letter should be entered in the <br />records; and is as follows: <br />"It is my opinion that the subdivision control statute applies <br />to this tract of land and that before the land can be developed <br />it would be necessary for a subdivision plan to be filed with <br />and approved by the Planning Board. The applicable statute is <br />Section 81K of Chapter 41 of the General Laws. The second para- <br />graph of that section specifically provides that the prior re- <br />cording of a plan shall not exempt the land from the applica- <br />tion of the subdivision control provisions, with certain ex- <br />ceptions that are not applicable lander the above facts." <br />Fbllen Hill Estates <br />Mr. Caouette representing R. Lockwood Tower and Mrs. Philip Tower <br />of Fbllen Hill Estates presented for approval plan of Brookwood Road by <br />Everett M. Brooks Co., C.'E.s dated July 1950. .Informal approval was given <br />subject to approval of Mr. Burns. <br />Lexineton Conatrtxetion Co. <br />Letter read from Aetna Casualty & Surety Co. re status of Lexing- <br />ton Construction Co. Copy of letter from Mr. Burns to Planning Board stat- <br />ing progress of work done to be sent to Aetna Co. <br />Custom Built Homes <br />Tatter read from Mr. Stevens re: issuance of certificates to Cus- <br />tom Built Homes. Moved by Pte. Caouette, seconded by Mr. Potter that the <br />form as outlined by Town Counsel be approved. So voted. When the certi- <br />ficate of Town Engineer to Planning Board is signed by Mr. Burns, then <br />Planning Board will sign certificates of approval and send to Custom Built <br />Homes. <br />Map prepared by Mr. Burns showing area between Edison Way and Depot <br />Square with proposed street and parking facilities, studied.
