PLANNING BOARD HEARING <br />June 13, 1938 <br />' Present:- Messrs, Greeley, Kimball, Nickerson, Ferguson and Ellis. <br />A public hearing was held under the provisions of Section 17 <br />of the Lexington Zoning By -Law in the Selectmen's Room of the Town <br />Office Building at 8:00 P. M, for the purpose of considering the <br />following proposed amendment to the Lexington Zoning By -Law: - <br />To substitute under Area Regulations, Section 6, a new section <br />6 to read as follows: <br />Section 6. (a) In R,1 and R,2 Districts no dwelling shall <br />be erected upon land laid out for house lots after the adoption <br />of this by-law unless there be provided for each such dwelling <br />a lot frontage of not less than 100 feet upon the frontage street, <br />and an area of not less than 12,500 square feet. On each side of <br />each dwelling or other permitted main structure there shall be <br />provided a side yard of at least fifteen feet in width, which <br />shall be kept open from the front line of the main structure to <br />the rear line thereof. <br />This paragraph shall not apply to lots of less than 100 foot <br />frontage duly recorded by plan or deed at the time this by-law is <br />adopted, <br />(b) Where a corner lot has its corner bounded by a curved <br />line connecting other bounding lines which if extended would inter- <br />sect, the frohtage and area shall be computed as -if such bounding <br />lines were so extended. <br />The Chairman declared the hearing open at 8:00 P, M, and the <br />Clerk read the notice of hearing which was published in the May 261 <br />1938 issue of the "Lexington Minuteman", <br />t <br />The Chairman explained that the matter to be considered was <br />the same as was presented to the Town at a previous Town Meeting <br />but that the Attorney General refused to approve it because of a <br />technicality. The Planning Board felt th4t the Town favored the <br />proposal so is going to present it again, <br />He asked to hear first from those who favored the proposal <br />and there were none who wished to speak. <br />He then asked for those who were opposed. <br />bIr. Walter Black stated that he did not want to,speak in <br />opposition but would like to see a little more consideration given <br />to side lines, He would like to see the side line fixed at 12 feet <br />and.the setback increased to 35 or 40 feet. He felt that a 20 foot <br />setback meant a poor neighborhood but with 35 or 40 foot setb&'ks <br />there is a very differdlit neighborhood, He felt that it was a. <br />' hardship to build a garage on -a lot with the side lines fixed at <br />15 feet. <br />
