PLANNING BOARD MEETING <br />January 24, 1936 <br />' Present;- Messrs, Duffy, Borden, Ellis, Sellars & Kimball. <br />Mr. Duffy directed attention. to House Bill 205, being <br />an act relative to laying out and care by the Cor=onwealth <br />of Freeways, etc. A Freeway being a highway, access to which <br />is permissible only through regularly laid out streets or <br />highways. <br />This bill.apparently seeks to take care of situations <br />such as we hope to protect along the Concord Highway, Mr. <br />Wrightington is to be asked whether he feels that act can <br />be construed as retroactive to existing highways or only <br />applicable to future ways. Mr. Borden expressed the opinion <br />that there was grave danger of attack on the grounds of con- <br />fiscation. <br />Note 1/25/36:- Mr, Roland Greeley tells the clerk that <br />he attended the hearing on the above bill, that the only <br />opposition was from one speaker who raised the question of <br />its being retroactive and that the bill is so loosely drawn <br />in this respect that the members of the Regional Planning <br />Committee are of differing opinions on this point. A new <br />bill in more definite form will probably be presented by <br />the Mass..State Planning Board, <br />The Town Counsel is to be requested to prepare an amend- <br />ment to the Zoning By -Law to provide for a fifty (50) foot <br />setback on the Concord Turnpike, Mr. Cosgrove has prepared <br />a map covering the sections adjoining the Concord Turnpike <br />but owing to the press of other work has not been able to <br />make any suggested layouts. <br />The informal hearing on Limited Apartment Buildings was <br />discussed and it was voted that in the light of Mr. Merriam's <br />request of January 21, 1936, to establish an R.3 District, <br />there will be prepared an amendment to the Zoning By -Law pro- <br />viding for such district and the Planning Board will insert <br />an article in the Town Warrant and will hold a hearing Feb- <br />ruary 28th on an amendment relative thereto. <br />In addition, it was voted that the Planning Board desig- <br />nate the area as affected by Mr. Merriamts petition to change <br />the property on Oakland Street from an Rol District to the <br />proposed R.3 District, and within which it is necessary to <br />obtain the signatures of owners of 50 percent in valuation <br />of the property to be as follows: <br />The area included within that bounded by Meriam <br />Street (both sides), from the southerly side of the <br />Railroad right of way to Abbott Road. <br />Abbott Road (both sides)o to Oakland Street. <br />Freeways <br />Concord <br />Turnpike <br />Limited <br />Apartment <br />Buildings <br />
