PLANNING BOARD bIEFTING <br />February 17, .1933 <br />A meeting of the Planning Board was held in the Conference Room of <br />the Toti�rn Office Building, Friday, February 17,- 1933. Messrs. Duffy, <br />Scheibe, Milne and Glynn were present. The Town Engineer and secre- <br />tary were also present. <br />Mr, Glynn suggested that Yr. Duffy draw up some resolutions Mr, <br />on the death of Mr. Emery who died Thursday, February 16, 1933. Mr. 'Einer 's <br />Duffy consented to do so and said he would present them at the next Deatt <br />meeting. <br />Upon motion made by Mr. Scheibe, Mr. Duffy was unanimously Chairman <br />voted as Chairman. <br />&ir. Duffy read a letter from Mr. Trask stating that the <br />Selectmen are considering the use of unemployed labor for deepening <br />and widening Vine Brook below Hayes Lane in accordance with recommenda- <br />tions of Metcalf & Eddy and that they have designated Mr. Custance Vine Brool <br />to confer with the Planning Board and work with them on a study of <br />the project. A letter was written acknowledging his letter and ad- <br />vising him that the matter would be brought up at an early date. <br />Tvr. O'Connell came before the Board in regard to his petition, <br />received Friday, February 17th, for a change in zoning of the tri- <br />angular lot of land at the junction of Woburn Street and Mass. Ave. <br />He said he wanted instructions from the Board as to what he was to <br />do for the hearing. Mr, Duffy informed him that the formalities <br />were the same. He must present a formal petition signed by 50° <br />Of the valuation of the property in the area designated by the <br />Board and deposit a fee of t2osoo, <br />Mr. Milne stated that this was the third time this petition <br />has been presented and there should be some change of reason for <br />presenting it over again. There should be some limit of time con- <br />trolling these petitions. <br />Mr. O'Connell stated that he did not realize that the Town <br />wanted it for a fire station until he was put on the Board of <br />Selectmen, and if he thought the Town wanted it novo he would post- <br />pone action on it. He said it was possible to bring the case to Daniel J, <br />court but thought it easier to bring it up at the Town Meeting and O'Connell <br />If the people did not want it, they could refuse the change. <br />Mr. Duffy called Mr..O'Connell's attention to Section 17 of <br />the Zoning Law and stated that a formal petition should be signed <br />by the property owners of 50% of the valuation, asking for the <br />change instead of just stating that they do not oppose the change. <br />Mr. O'Connell stated that he would draw up a form of petition <br />f.rom Section 17. He is not asking for a waiver of the 20 ft, set- <br />back. He agreed to deed to the Town any part of the land at the <br />corner of Hayes Lane for the Extension of Sherman Street. If the <br />Town would use the triangle, he would postpone action on it, but <br />the Board of Selectmen and Mr. Blake, who was on the committee <br />Investigating the matter, have reported definitely that they do not <br />want it for a fire station.
