BOARD OF HEALTH MEETING
APRIL 12, 1983
The regular meeting of the Board of Health was held on Monday, April 12,
1983 at 7:15 p.m. in the Board of Health Office.
Members present were: Mr. James W. Lambie, Chairman; Dr. Michael S. Erdos,
Linda Roemer, Ph.D. and George A. Smith, Director of Public Health.
Mr. Smith told the Board that the "No Smoking" by-law that requires res- NON-SMOKING
taurants to set aside 1/4 of their seats for non-smokers. It does not BY
-LAWS
become a by-law until tow meeting is finished then the town clerk has
30 days to file it with the Attorney General's Office. Mr. Smith said
it won't probably be put into effect until October or Novenber by the
time the Attorney General sends it back.
Mr. Smith said a place like Brigham's cannot comply the way the restaurant
is set up so the manager is now working with Brigham's to come to a reasonable
solution.
The social clubs and the Sheraton -Lexington lounges (they don't serve food)
would be excluded from the By-law. Mr. Smith said that some restaurants
have logistic problems and some restaurants will find it difficult to abide by
the new smoking (non-smoking) by-laws and will have some problems. Mr. Smith
said that places like Mario's and Chadwick's will find it is difficult to set
up non-smoking areas.
Mr. Smith told the Board that Lisa Fitzgerald wants the animal permit in her
name instead of her mother's. The Board was in agreement for George to LISA
write to Lisa stating the Board wants documentation that her mother has FITZGERALD
leased the land to her.
The Board was also in agreement that she should not increase the number of
horses from 3 (with 1 extra with a variance) to six. The Board did agree
to the 3 horses with the one extra with a variance.
There is 3.5 acres of Fitzgerald land. She borrows land from the abuttor
but Mr. Johnson does object to the riding school Liza has been operating.
Mr. Freeman came before the Board in regard to the property at 47 Ridge TED
Road that he had purchased with the land around it. The tenants have moved FREEMAN
out for over 60 days and now they want to move back in. He said the house 47 RIDGE
is in deplorable condition. The people are elderly and they had rubbish and ROAD
trash everywhere. Their septic system was connected to the brook. The house
is really uninhabitable and should be condemned.
Mr. Freeman said he had done everything that was asked of the Health Director -
covered over the wells, and boarded up the house.
The Scheme's could not come to the last meeting. They have been haling their
lawyer, Mr. Tropeano doing business for them. Mr. Tropeano was invited to
attend tonight's meeting but was unable to come. He did have a conversation
with Mr. Smith and asked Mr. Smith what he would recommend. Mr. Smith said
he would recommend not letting the Schena's back into the house.

Mr. Freeman said he paid $250,000 for theland and house. He tried to
get Mr. Tropeano to come and see the conditions that the 86 year old couple
were living in.
After further discussion, the Board agreed to condemn the house as living
quarters. Mr. Smith said the Building Commissioner could order the house
torn down.
Mr. Smith discussed with the Board the idea of charging for issuing of
BURIAL burial permits to the funeral directors that come into the Board of Health
PERMITS Office. He said some towns do charge a fee for this service.
The Board decided that it would be best at this time not to charge for
the issuing of a burial permit.
Mr. Smith told the Board about the stuffed chicks that had been imported
to this country around Easter time. They killed live chicks and then stuffed
STUFFED them with a filler that contained arsenic. He said they had a high bacteria
CHICKS count.
He found that Joel's Candy Store had sold 14 of them and Mr. Smith was
able to get two of them back and take them to the State Lab.
He wrote an article for the Lexington paper this week so people can be
aware of this.
We had received a notice that many restaurants have been using sulfite in
their food, particularly in the salads to keep them fresh looking. Mr. Smith
SULFITE visited the restaurants and made them aware that they can use this only if
they post a sign stating that that they do. Some restaurants had been using
sulfite but they agreed to stop using it. This is very detrimental to the health
of asmatics.
SWIMMING Mr. Smith told the Board that the State has redone the swimming pool regulations.
POOL BEGS. He is going to work this year with the new chemical standards. There have been
very stringent changes in the regulations.
Mr. Smith mentioned briefly that chlordane is now illegal to have in one's
possession. Some people have brought chlordane into the office and a disposal
CHLORDANE truck is coming tomorrow to take it away.
The Rabies Clinic has been set for May 26 and May 27, 1983 from one to four p.m.
RABIES Mr. Smith said if we don't have a good turnout this year - we will cut it down
CLINIC to one day next year.
He told the Board that we will not be selling licenses at the clinic this year.
Ginny Brady had reported that she received some hostility in East Lexington
because of cutting back of the blood pressure clinic there.
The Health Fair will be held on May 14th at the Fire Station. The Board
of Health is working with Choate -Symmes for the fair.
Cancer detection clinic will be held on May 10th in Cary Hall.

Mr. Smith told the Board that he will be working without an intern shortly.
He and Ellen Ripton came to a mutual agreement. She has also been working
another job and has been working 60-70 hours a week. She will be leaving
the end of April.
Mr. Lambie said we should now go after a permanent sanitarian.
The Board discussed mosquito control and Mr. Smith presented a letter from
Dave Henley of E.M.M.C.P. for the Board to read.
The Board thought it was a very good letter.
Linda Behar has written a letter to Lincoln and Bedford asking them for
their suppor to establish a permanent monitoring program for the mosquitoes.
The Board is only advocating a non -spraying program at this time. Mr. Smith
said if we have to get into spraying, the Town Manager will have an answering
service set up that the people can call.
The Board decided to get a little packet together and present them to the
Town Meeting Members. It would include: the letter of David Henley's,
Dr. Goldman's letter, Dr. Frechette's letter and an article written by Dr.
Linda Roemer.
After further brief discussion of mosquito control the meeting was adjourned.
Next meeting May 9th.
