BOARD OF HEALTH MEETING
OCTOBER 1, 1973
The regular meeting of the Board of Health was held, Monday,
October 1, 1973 at 7:00 p.m. in Conference Rood G-15 of the Town
Office Building. Members present were: Dr. William L. Cosgrove,
Chairman; James W. Lambie, Dr. Charles Ellicott and Robert C.
Heustis, Director of Public Health.
The minutes of the September 10, 1973 meeting were approved
as read.

The final regulations governing the Agriculture Land Im-
provement Project for Ralph Cataldo, 81 Bow Street, was dis-
cussed by the Board.
Dr. Cosgrove explained that Mr. Cataldo had requested that
CATALDO'S the permit state that any member of his family could carry on
LAND FILL the project in case something happened to him. Dr. Cosgrove said
he would agree to let the permit pass to Ralph's wife or son but
not to other members of the family such as one of the brothers.
Mr. Lambie said according to the regulations this permit
had to be renewed every 12 months.
Dr. Cosgrove said he agreed that the permit had to be re-
newed every 12 months but we had given Mr. Cataldo a letter
approving the project for a period of 3 years to give to the
Town of Arlington.
Dr. Ellicott said no matter how the permit is worded we
still have the power to revoke this permit if there is any
violation to these regulations.
Mr. Heustis said he thought if the permit was issued in
both Mr. Cataldo's name and his wife's name that would cover
the immediate family.
Dr. Ellicott said not with standing this permit is non-
transferable and therefore must be renewed every year according
to our Rules and Regulations, Chapter IV, section 6.
Mr. Cataldo had also requested a starting time change
from 8:00 a.m. to 7:00 a.m. because Arlington Public Works
Department starts to work at 7:00 a.m. This was approved.
The Board approved these changes and the permit will be
granted to Mr. Cataldo for his Agricultural Land Improvement
Project at 81 Bow Street under the following conditions:
(1.) The operation shall be conducted Monday through
Friday from 7:00 a.m. to 5:00 p.m.
(2.) Trucks shall be covered and protected.
(3.) The access road shall be secured so that only
authorized vehicles may enter.
(4.) The fill material shall be graded at least once
a week after being placed on site.
(5.) Excavations that may accumulate standing water
that may be a danger to the public health and safety shall be
protected.

(6.) To the extent possible the cell method of land
fill shall be used in order that the amount of area excavated
at any one time may not exceed 30,000 square feet.
(7.) Dust and erosian measures shall be used as needed.
(8.) Bench marks shall be established so that the depth
and extent of fill may be easily determined.
(9.) Only clean fill, free of offensive material, paper
and trash, shall be allowed.
(10.) A plan shall be filed with the Board of Health and
will show a finished grade of at least twelve inches of loam ex-
tending to the bottom of the slope and the slope shall be seeded.
(11.) The permittee shall allow the Board of Health or
the representative to inspect the landfill operation.
(12.) The permittee must comply with the by-laws of the
Town of Lexington with the rules and regulations of any board or
commissions having jurisdiction therein.
(13.) The permittee shall stop the landfill operation at
this site upon order of the Board of Health if it has been deter-
mined that the terms and conditions of the permit or any applicable
rules and regulations have been violated.
(14.) The permit is issued for the purpose of agricultural
land improvement only and shall be non -transferable and shall im-
mediately expire if the use of the land for agriculture purposes
is discontinued.
Mr. Heustis reported that a letter had been received from MASON -
the County Commissioners which stated that they would sustain MacDONALD
the ruling of the Board of Health in the case of Russell B. Mason
and Walter MacDonald horse hearing held September 19, 1973 at
the County Commissioners Office.
Dr. Cosgrove reported that he and Mr. Heustis had checked the
Battle Green Inn twice since the last Board Meeting and conditions
were very bad. He said they have started to clean a:nd paint BATTLE
but they were not moving as fast as he thought they should. GREEN INN
Mr. DeVries said he would do 4 rooms at a time but with only
one man working this procedure c()uld take quite a long time.
He went on to say there was no xageration with the con-
ditions in the kitchen, but the hot water booster had been in-
stalled. Mr. DeVries had fired the manager and hired a new
manager. Mr. Hanafin, the new manager, told Dr. Cosgrove he was
a restaurant man more than a hotel man.
Dr. Cosgrove said he felt they were not making much progress
and after talking with Mr. O'Connell he felt the Board should set

a reasonable time for Mr. DeVries to get this place cleaned
up. Dr. Cosgrove said he felt a reaonable time was ninety
days, then the Board could see how much of the job Mr. DeVries
had done and if he was sincerely trying to get this work done
an extension could be granted.
Mr. Heustis said he would take the memo sent to the Board
listing the things that had to be done and send a letter to Mr.
DeVries stating that he had ninety days to make the corrections.
The Board approved this action.
The Flu Clinic for the citizens 65 years of age or older
was discussed and it was agreed that the Clinic would be run
in conjunction with the Town Employee Clinic on October 18 and
November 1, 1973. A notice with a rear off registration blank
will be mailed to all members of the senior citizen group, an
ad will also be placed in the paper. It was agreed that if
any of the senior citizens attending the Well Elderly Clinic
could not attend the clinics at Cary Hall provisions would be
made to take care of them at the Well Elderly Clinics, this
information would not be advertised.
L.V. N. A. The request from the Lexington Visiting Nurse Association
BUDGET for a $2500.00 increase in payment of services to the Board
of Health was discussed.
Dr. Ellicott stated that the L.V.N.A. would be going up
on their costs per visits and also there was no indication that
the Trustee of public Trusts would give the Health Department
any funds for the Well Elderly Clinic for another year so that
was considered in this increase.
A number of questions were asked about the services and the
sources of referral. After a short discussion it was agreed to
ask Mrs. Tapier and Mr. Frank Totman to attend our next meeting
to discuss this $2500.00 increase.
SUBDIVISION The premiminary plan of a subdivision entitled "Farmhurst"
"FARMHURST" off Bridge Street.
Mr. Heustis reported that this subdivision will have public
water and sewer but the Board of Health will be concerned with
the drainage. The plan submitted did not have enough information
shown on the plan therefore he will have to request that the
developer submit more information regarding the drainage and
also a plan showing the finished grades.
MEDAS Mr. Lambie said he thought Mr. Heustis should check out
ANIMAL the horse stable located in the Lexington -Waltham line. He
PERMIT said there was new buildings being built in that area and he
wondered if these would not make a difference in the keeping
of the horses there.
