BOARD OF HEALTH MEETING
MARCH 16, 1965
The regular meeting of the Board of Health was held
Tuesday, March 16, 1965 at 7:00 P.M. in the Health Depart-
ment Office. Members present were R. L. McQuillan, Chair-
man, Mr. James M. West and Director of Public Health, James
F. Finneran.
Minutes of the February $, 1965 meeting were approved
as read.
MILK COUNTS The letters to Brox's Dairy, Concord Dairy and Cumberland
Farm Dairy calling their attention to the high bacterial counts
and Coliform Counts obtained from the laboratory analysis of
milk January 14, 1965 was approved.
Mr. Finneran reported that replies were received from
Brox's Dairy and Concord Dairy. Brox Dairy has assured full
cooperation to insure against a repition of this situation,
and although the letter from Concord Dairy stated they objected
to our letter and requested more and frequent tests of their
products the Board felt that a warning letter for even one
high count was necessary to insure the residents of the highest
possible quality control.
B.L.CUMMINGS Mr. McQuillan reported that he had written a letter to
MILK CO. Mr. Lincoln Cole, Chairman of the Board of Selectmen, requesting
permission to either have Mr. Legro, Town Counsel, go to
court and take action regarding the restraining order on Mr.
Finneran in regard to B.L. Cummings Milk Co., or give the
Board permission to employ legal council to see this case
through.
Mr. West said he approved any action that would speed
the settling of the B.L. Cummings Case.
Mr. McQuillan said he felt Mr. Legro had done an excellent
job on the case but that he was so busy with other Town matters
he did not have the time to devote to getting this case settled
as quickly as possible. He also stated that he had consulted
two judges on this matter and they explained that a restraining
order was a temporary thing and they did not understand how it
could be carried on so long. He also understood that he or the
Board could demand that this restraining order be put on the
court calendar under an impartial judge and immediate action
demanded.
Mr. Finneran said as soon as the restraining order was
settled he could go to Concord Court and have the case that is
pending there heard and a decision made.

The Board agreed that until the Board of Selectmen acted on
their request no action could be taken.
The memo to John Carroll, Superintendent of Public Works,
regarding the tests in the drainage ditch at 10 Ross Road was
approved by the Board.
Mr. Finneran explained that Mr. Herbert Nickerson, State
Sanitary Engineer, was in on a routine visit last week and he
requested that the State Health Department take water samples
for testing about three times a year at the Hartwell Avenue
Dumpsite just to double check the samples we are taking and to
insure that no pollution will develop down stream in the
neighboring Towns. The approved of this action.

DUMPSITE
The Oak Park subdivision was approved by the Board. This OAK PARK
subdivision will be on public sewer and the Whitman & Howard SUBDIVISION
report approved it providing the cellar floors in all cases are
kept at least as high as the top of the street drains and pre-
ferable a foot higher.
The subdivision entitled Pine Knoll, Section 1, was app- PINE KNOLL
roved by the Board. This subdivision will be on public sewer SECTION I
and the Whitman & Howard report stated that it was satisfactorly
designed for drainage.
Mr. McQuillan suggested that a copy of all engineer reports
on subdivisions be sent to the Planning Board with the approval
letters. Mr. Finneran said this would be done in the future.
The letter from Francis Benoit, 2 Morris Street, requesting 2 MORRIS
that Article 15, Town Meeting Warrent, be given favorable consid- STREET
eration. Mr. Benoit had sent this letter to all Town Departments
and all Town Meeting Members. Article 15 would provide appropria-
tion for the installation of a trunk sewer line through to the
lower end of Winter Street and this would enable the people on
Morris Street to connect to Public Sewer. The area around Morris
Street has been on the top of the recommended sewer installations
list every year and until this trunk line is installed the condi-
tion in this area cannot be relieved.
Motion was made that the Secretary cast one vote for the APPOINTMENTS
following appointments for the year 1965-66:
