BOARD OF HEALTH MEETING
May 18, 1959 .
A meeting of the Board of Health was held on Friday,
May 15, 1959, in the Selectmen's Room, Town Offices, at 3
P. M. with Chairman McQuillan, Dr. Cosgrove, Mr. Cole and
Health Officer Lurvey present.
An application for fin&i ia1 aid in'payment for drugs
for a tubereuloabia case, Edwin Waite, 68 Bow Street,was
discussed, and the Board's decision was that Mr. Waite is
financially able to take care of payment for medicine. He
receives 40 a week from the Railroad Express for retirement
owns his own home and a summer cottage, both free and clear
a 1958 car, and his daughter and son-in-law, living with
Mr. Waite, contribute nothing. The Board feels the family
can assume these bills for drugs, amounting to approximately
$21 a month. The Board has written to Mr. Waite to this effect.
Mr. John Sellars has submitted an application for a lic-
ense to pasteurize milk, 430 Concord Avenue. Mr. Lurvey will
make an inspection of the place with the State Inspector. Mr.
Lurvey says Mr. Sellars must break pipe lines down, and he has
always refused to do this. The Board agreed to issue a license
after Mr. Lurvey makes the inspection and so recommends. k
letter is to be sent from the Board to the effect that the
matter is being taken under advisement subject to Mr. Lurvey'a
inspection or investigation.
The minutes of the April 17th meeting of the Board were
approved after the following corrections were made: Page 2
Paragraph 4, 34 Webster Road, not 34 Wyman Road, letter sent
to Whitman & Howard; Page 2, Paragraph 5, a permit will be
issued to Carroll Brothers, 31 Allen Street, to keep swine,
"if within 30 days you have corrected the violations listed
in previous letter"; Page 2, Paragraph 5, Alfred Whitman,
not Warren, at 34 Wyman Road not Webster Road; Page 3A,
Paragraph 4, 36 Wyman Road, asked to abate the nuisance of
an open dump, not overflowing laundry waste.
Carroll Brothers, 31 Allen Street, have not complied with
most of the violations for keeping swine. He has whitewashed
buildings, but nothing alae. Mr. Lurvey recommends asking the
district court to set a hearing when Mr. Carroll would be asked
to explain why he does not comply.lthe eourt-would ordir-hii
to; comply 'within a certain number of days or he brought to
court. The Board voted to have Mr. Lurvey set up the hearing.
Mr. Lurvey reported a letter was sent as approved at the
last meeting to Lester Fogg, 239 Woburn Street, asking him to
abate the nuisance of an open dump, and enclosing applications
for an animal permit as he is keeping ducks without a permit.
The Board voted to issue an order to abate the nuisance of an
open dump and also to obtain a permit to keep ducks.
Mr. Lurvey reported that the sewage facilities are still
not completed at the Grace Chapel, Worthen Road. The churdh_
opened last Sunday. Mr. Lurvey told the owners that the build-
ing should not be opened until the ejector pump is installed.
The New England Pump & Machinery Company has notified Mr. Lurvey

that the delay is due to the fact that the pump has not arrived.
The Board voted to notify the authorities that "unless the
toilet facilities can be accepted as temporary (so no health
nuisance exists) the Board orders that the facilities be locked.
Mr. Lurvey reported in connection with polio vaccine that
Dr. Philbrick, Massachusetts Department of Public Health, and
Agent in Randolph, has canvassed his town to see if all children
have had polio inoculations. Mr. Lurvey wonders if Lexington
should have a clinic for people in Lexington who have not had
any. shots. It would have to be three clinics. The Board de-
cided to find out the demand by putting an article in the
newspaper. The age limit was set at between six months and
eighteen Years, no charge. It was felt that to conduct clinics
for all ages would be interfering with the Lexington doctors.
The question of a dump in the rear of 29 Pleasant Street.
owned by Donal Wilson Jr. was discussed, and the Board voted
to order him to clean it up.
It was voted to send an order to the owner to abate the
nucisance of an overflowing cesspool at 20 Hudson Road.
The Wingate Road area and the policy of asking people who
are within 200 feet of a town sewer to connect was discussed.
Mr. Joseph Chisholm has some lots on Waltham Street which come
within this category. The Board voted to have Mr. Lurvey check
with the engineers to see if it is physically possible to con-
nect to the sewer. If possible the Board feels it must not
let Mr. Chisholm build with cesspool or septic tanks. In re-
gard to the lot on Wingate Road, as nine other houses there
were allowed to use cesspools or septic tanks before the policy
was established to make them wait for sewer in that area, it
was voted to allow a private sewage disposal system be const-
ructed on Lot 10 Wingate Road.
Mr. Kraynick came into the meeting to discuss nine lots
of Paul Tocci}s on Valleyfield and Bridge Streets. These lots
have been condemned or rejected several times. It is all flat
land, the surface water just stands there. Mr. Kraynick said
he would only approve these lots if a pumping station was built
and they could then be connected to the Public Sewer.
Mr. Kraynick brought up the subjeot of a lot #148, 149 and
150 on Tarbell Avenue saying he would approve this lot if he
can get the system in, not much leeway. The Board voted to
approve the lot if the bed can be fitted in, and if it meets
with the approval of the engineer. Mr. Kraynick wants the leach-
ing bed dug out.
Mr. Lurvey reminded Mr. Kraynick that a letter is due at
tha Planning Board on May 18 in regard to Oak Hill, Section II,
Wynwood Associates. The Board made a motion to approve this
section it the engineer approves.
A report from Whitman & Howard, Engineers, concerning 34
Webster Road was noted.

An order has been sent by the Health Officer to Charles
Centore, 32 Lawrence Lane, telling him that he is installing
a laundry tray in the basement illegally, etc. Mr. John
Byrne, the Plumbing Inspector, had notified Mr. Lurvey, and
they have investigated.
A letter was sent to Mrs. Evelyn Silva, 12 Cedar Street,
asking her to correct the nuisance of rubbish on her property.
Mr. Lurvey reported that hr. Bourne., 183 Bedford Street,
is taking care of the overflowing cesspool on his property.
He is building another cesspool.

an overflowing sewage disposal system. The cellar is still
full of water, yard covered, laundry waste still spilling onto
the ground. Mr. Lurvey recommended that he .set up a hearing
in the district court. The Board agreed.
A letter was sent to the Planning Board regarding Middle
Ridge Section 3.
A letter was sent to the planning Board regarding Vine
Brook Realty 'Frust.
A letter was sent to Mrs. Daniel A. Whitney, 44 Fletcher
Avenue, ordering her to connect to the town sewer. If ledge is
encountered and great expense will be involved, the Board is
willing to let her build a new cesspool or whatever is needed
to correct the nuisance.
A letter was received from H. P. Hood & Company notifying
the Health Department that a worker there has a son ill with
scarlet fever. He will remain out of the plant the necessary
week as he comes under the regulation of milk and food handling
and a communicable disease.
The Fairlawn Nursing Home has been inspected by the Health
Officer and found in excellent condition. The Board approves.
A letter was sent to Gaetano Franceschelli, 34 Grapevine
Avenue, after several complaints of pig manure odors by neigh-
bors. This has been taken care of..
A letter of approval has been sent to the Unitarian Coop-
erative Nursery School to use another room and expand the
school
A letter was sent to Eugene P. McCarthy, 3I Maple Street,
concerning the overflowing cesspool and dry well. The sewer
is 300 feet away approximately and the McCarthys are trying to
get the town to extend the sewer so they may connect. Mr.
Lurvey has recommended to the McCarthys that an overflow leach-
ing trenoh be built. The Board votes to order them to abate
the ndisance in seven days.

Mr. Lurvey reported a letter has been sent to Mr. Burton
Mitchell notifying him that the Board is of the opinion that
he is financially able to pay for the hospital bill for his
premature baby.
A letter was sent as voted by the Board at the last meet-
ing to Mr. William J. Smith, 36 Wyman Road, asking his cooper-
ation in abating the nuisance of an open dump. This was an
order.
Mr. Lurvey reported Alfred Whitman, 34 Wyman Road, is work-
ing on the putting in of a pump into trays, etc., and would
like Mr. Whitman to have more time to complete this work.
A letter has been sent to Mrs. Leila M. Paone, 15 Emerald
Street, concerning rubbish nuisance. Mr. Lurvey reports it
is actually a junkyard, old card, metals of all descriptions,
etc. The Board voted to notify the Selectmen of this junk
business.
An order was sent to Arthur E. Blunt, 9 Barrymeade Drive,
to abate the nuisance of an averflowing sewage disposal system.

he set up a hearing in the district court.. The Board agreed.
In the case of Helen M. Kerr, 337 Lincoln Street, over-
flowing cesspool, Mr. Lurvey recommended a hearing be set up
in district court as nothing has been done to correct. The
Board so voted.
No result has been seen after a. letter to Robert M. Leslie
8 Lake Street, concerning_ odors. Mr. Lurvey said perhaps he
could put in 18" of nice gravel to soak up the overflow. The
Board voted to have Mr. Lurvey set up a hearing in district
court.
The Board approved the appointment of Francis J. DeGuglielmo
as Special Agent for the Board of Health at Metropolitan State
Hospital (to sign death certificates).
The Lexington Visiting Nurses Report for April was noted
and accepted.
The Clerk reported permits for rummage sales were approved
for the Woman's Society of Christian Service, Lexinton Methodist
Church, on May 16, 1959; DeMolay on May 16, and for the Pollen
Community Church on May 23, 1959, as no diseases have been
reported in the homes of the donors in the previous six weeks.
The Health Officer's report for the period was discussed.
Mr. Sole said in regard to Mr. Friel, 2933 Massachusetts Avenue
(Page 7) that Mr. Friel has talked to him, and is just confusing
the whole thing. Mr. Friel suggested a third cesspool in the
area of the other two. He was told by Mr. Kraynick to put it
at the back of the lot where the land has been tested, 6 or 8
feet down. He hasn't done it. The Board voted to notify Mr.
Friel that they want him to follow thru as told, and Mr. Lurvey
will make sure of this.
