BOARD OF APPEALS <br />September 29, 1977 <br />The Board of Appeals held a regular meeting on Thursday, September 29, 1977, <br />beginning at 7:30 p.m., in the Selectmen's Meeting Room, Town Office Building. <br />Present: George P. Wadsworth, Chairman <br />Ruth Morey, Vice Chairman <br />Woodruff M. Brodhead <br />Irving H. Mabee <br />Thomas G. Taylor <br />Public hearings were held on the following petitions, notices of the hearings <br />having been mailed and hearings advertised in the Lexington Minute -Man newspaper <br />as required by statute.. <br />Suprokash Sarker - special permit, pursuant to Section 30.3, to build an addition <br />at 40 Garfield Street. The addition will be a 12 ft. x 20 ft. garage which will <br />have sufficient front aid rear yards but will have a side yard of 3 ft. instead of <br />7 1/2 ft. <br />Bernard Donahue - variance of Section 27 of the Lexington Zoning By-laws in order <br />to complete construction of a fenced in above ground 4 ft. deep swimming pool <br />located at the rear of 27 Carville Avenue. The pool is located a distance of 7.5 <br />ft. from the abutters' property line on the right side and a distance of 4 ft. <br />from the conservation land located in the rear. The fence surrounding the pool <br />will be stained redwood. Petitioner is willing to provide shrubbery or any other <br />planting suggested to keep, the pool aesthetically pleasing to users of the conser- <br />vation land. <br />DECISIONS: The Board made the following decisions, all in open meeting. See de- <br />cisions filed with the Town Clerk and in Board of Appeals' files for more details. <br />Sarker - granted unanimously. <br />Mroczkowski - granted unanimously. <br />Hail - denied unanimously. <br />Donahue - granted unanimously subject to certain conditions. <br />Other information and discussion: <br />Mrs. Morey has been appointed a member of the "Select Committee" established <br />for the purpose of updating our zoning by-laws. <br />Problems with Sections 25, 30 and 40 continue to be expressed by Board Members. <br />Home occupations is another category for questions under definitions. The Board <br />agreed to make recommendations to Town Meeting especially in regard to their posi- <br />tions on Use Variances, PUD's (Section 33) and Non -Conforming Uses. <br />Jacek A. Mroczkowski _ variance of Section 27 (Dimensional <br />Controls) to permit <br />remodeling at <br />11 Bates Road, converting an existing carport <br />into a garage, adding <br />a 14 ft. x 22 <br />ft. extension with cellar below, and also a 6 <br />ft. wide deck, all as <br />shown on plans <br />submitted to the Board of Appeals. Conversion <br />with additions will <br />leave a side yard <br />of 8.7 ft. at the far end of the dwelling <br />because of the unusual <br />nature of the <br />property line. <br />Ralph H.
