BOARD OF APPEALS <br />July 14, 1977 <br />The Board of Appeals held a regular meeting on Thursday, June 9, 1977; <br />beginning at 7:30 p.m., in the Selectmen's Meeting Room of the Town Office <br />Building. <br />Present: George P. Wadsworth, Chairman <br />Ruth Morey, Vice Chairman <br />Woodruff M. Brodhead <br />Robert M. Gary, Associate <br />William J. Scouler, Associate <br />Public hearings were held on the following petitions, notices of .the hear- <br />ings having been mailed and hearings advertised in the Lexington Minute -Man <br />newspaper as required by statute. <br />Joseph P. DiMatteo - variance of Section 27 in order to build a carport with a <br />front yard setback of 20 ft. instead of the required 30 ft. on the property at <br />216 Lincoln Street. <br />Thomas J. Casey - variance of Section 27 in order to build a shed (12' x 12' x <br />12') of plywood covered with aluminum at 9 Alpine Street for storage of garden <br />tools and summer furniture. <br />George E. Foote, Jr. - special permit, pursuant to Section 25.81 of the Use <br />Regulation Schedule of the Zoning By-laws, to have a law office at 69 Oak Street <br />to conduct the practice of law on a part-time bases, i.e. between the hours of <br />5 p.m. and 9 p.m. on weekdays and on weekends during the day. <br />Bernard Donahue - variances of Section 27 of the Lexington Zoning By-law in <br />order to complete construction of an above ground 4 foot deep swimming pool <br />located at the rear of 27 Carville Avenue. Construction of the pool was begun <br />a distance of approximately 1.5 ft. from the rear lot line instead of the re- <br />quired 15 ft. and approximately 1.5 ft. from the side lot line instead of the <br />required 10 ft. <br />Moore Homes, Inc. - special permit, pursuant to Section 38 (multi -dwelling- RD) <br />and related sections of Lexington's Zoning By-law for the development of Fiske <br />Common for 45 living units consisting of 4 one -bedroom units, 18 two-bedroom <br />units and 23 three-bedroom units (these units in 19 buildings) plus garages on <br />a parcel of land on the southerly side of East Street and the Northeasterly <br />side of Fiske School, land containing 16.35 acres and described in Section 22.52 <br />of Zoning By-law. <br />Article 86 of March 1977 Town Meeting rezoned subject parcel plan to RD and <br />accepted plans as presented to it. <br />Petitioner requests a variance from the provisions of Section 27 to permit <br />10 ft. and 20 ft. distances between buildings and garages (as indicated in peti- <br />tion) instead of the required 30 ft. <br />Also Petitioner requests a variance from Section 25.80 (which states garage <br />space for parking not more than 3 automobiles) to allow parking of no more than <br />6 automobiles per garage, all as shown on plans and described in data submitted <br />to the Board. <br />
