BOARD OF APPEALS <br />February 4, 1977 <br />The Board of Appeals met in Room G15 of the Town Office Building on Friday, <br />February 4, 1977 at 4 p.m. Notice of this meeting was posted with the Town <br />Clerk *s required by law. <br />Present were: George P. Wadsworth, Chairman <br />Ruth Morey, Vice Chairman <br />Woodruff M. Brodhead <br />Irving H. Mabee <br />Thomas G. Taylor <br />Robert M. Gary, Associate <br />Clarence D. Turner, Associate <br />Members present approved the copy of the Lexington Enterprises, Inc. decision <br />as written. It would be posted with the Town Clerk on Monday, the 7th. <br />Board members expressed their opinions in regard to Chapter 808 and certain <br />action';of the Planning Board in regard to zoning by-law changes which may be the <br />subject of Warlrant Articles for Town Meeting. Thomas Taylor reported on meetings <br />he had ;attended, sponsored by a planning board appointed committee of which he is <br />a member. Since there was no official planning board report available at this <br />time on which to make comments no official action was taken. <br />A letter in regard to the possible use by one of Lexington's churches of <br />a portion of their new wing for office purposes was discussed by Board members <br />with resulting reactions expressed from a "good idea" to "strongly opposed". <br />It wasidecided that more thought should be given to possible precedent being set <br />by any action taken at this time. The reason given for the church wishing to <br />use their building in this way was financial difficulties. It was considered <br />wise to allow this church to go unnamed for obvious reasons. (Rent office <br />space in church building in residential district.) <br />The Massachusetts Avenue grocery store, 1049 Mass. Ave., which according to <br />Board of Appeals Permit for Variances granted to F. William Smith on October 2, <br />1975 must terminate,was the subject for discussion. (see permit for variance). <br />Condition No. 1 of the permit for variance specifically states that its use <br />must be terminated. The store is no longer protected by any non -conforming <br />status. If the owner desires to keep the store, he'll have to request a <br />variange, which the board may grant or deny. It would be a variance for "use" <br />in a residential zone.was the consensus of those present. <br />The meeting adjourned at 5:12 p.m. <br />Respectfully submitted, <br />Evelyn F.
