BOARD OF APPEALS <br />December 30, 1976 <br />The Board of Appeals held a regular meeting on Thursday, December 30, 1976 <br />in the Selectmen's Meeting Room of the Town Office Building at 7:30 p.m. <br />Present were: George P. Wadsworth, Chairman <br />Ruth Morey, Vice Chairman <br />Woodruff M. Brodhead <br />Irving H. Mabee <br />Thomas G. Taylor <br />Public hearings were held on the following petitions, notices having been <br />mailed as required by statute and hearings advertised in the newspaper. <br />Jann Patrice Swanson - variance so as to maintain on the property at 21 Ellison <br />Road an existing dwelling house with an enclosed porch attached thereto, 13.66' <br />from the southerly side line instead of the required 15'. <br />Wilfrid B. and Mary Veldkamp - variance to maintain an existing garage on the <br />premises at 7 Bird Hill Road (formerly numbered 6 Rockville Avenue), with a <br />rear yard setback 19.2 feet from Bird Hill Road instead of the required 20 feet. <br />Joseph G. Sakey and Shirley A. Sakey, d/b/a Cain's Seafoods - special permit, <br />pursuant to Section 25.69, to serve food at Cain's Seafoods, 321A Woburn Street. <br />The business is presently set up as a take-out service. The business is owned <br />and operated by Joseph and Shirley Sakey, 60 Forest St. The store is leased <br />from Countryside, Inc., 295 Woburn St. <br />Trustees of Drummer Boy Trust - special permit pursuant to Section 38.2 for the <br />development of eighty (80) dwelling units comprising the second phase of Drummer <br />Boy Green approved at Town Meeting on May 6, 1974 and located on Bedford and <br />Winter Streets as shown on plan submitted to Board of Appeals. Variances are <br />requested from the provisions of Section 27 (Schedule of Dimensional Controls) <br />to permit the minimum distance between buildings to be reduced below thirty (30) <br />feet at certain locations as indicated on plan SP -6 dated October 27, 1976 accomp- <br />anying the petition to the Board of Appeals, to permit front, side and rear yards <br />to be reduced below forty (40) feet at certain locations as indicated on plan SP -6 <br />and to permit the minimum lot area of each of the seven cluster lots to be reduced <br />below ten (10) acres as indicated on the plans accompanying said Petition. <br />The Board made the following decisions, all in open meeting. See decisions <br />for details, all in Board of Appeals' files and also filed with the Town Clerk. <br />Swanson - granted, unanimously. <br />Veld - No decision. No one was present to represent the Petitioners. <br />Sakey -'denied, two voting in favor, three in opposition. (Woodruff M. Brodhead <br />and Thomas G. Taylor voting in favor). <br />Drummer Boy -- by unanimous vote, decision postponed to January 6, 1977. <br />1 Other action, decisions and information: <br />The Board signed the Lexington Garden's special permit as submitted. <br />The subject of restaurants was discussed, especially in regard to Sesame Restau- <br />rant, next door to Cain's (see above). The selectmen had written a letter that <br />they mujot come to the Board of Appeals for a special permit under 25.69. <br />
