BOARD OF APPEALS HEARINGS <br />November 13, 1975 <br />' A regular meeting of the Lexington Board of Appeals was held on Thursday, <br />November 13, 1975 at 7:30 p.m. in the Selectmen's Meeting Room of the Town Office <br />Building. Present were four regular members and one associate member: Chairman <br />Donald E. Nickerson, vice-chairman George P. Wadsworth, Ruth Morey, Woodruff M. <br />Brodhead and associate Natalie H. Riffin. Also present in addition to petitioners <br />and/or their attorneys, were a Lexington Minute -Man reporter, two representatives <br />from the League of Women Voters, and a room full of townspeople. <br />Public open hearings were held on the following petitions, notice having been <br />mailed as required by law to abutters, etc. and to town boards and officials. <br />Notices were published in the Lexington Minute -Man newspaper as required. See <br />copies of the permits and denials which were issued for these hearings for more <br />details. <br />Robert and Dorothy Little - variances to maintain existing buildings at 18 Whipple <br />Road with insufficient setback as follows: (1) garage - 27.7 ft. instead of 30 ft. <br />(2) house - 29.7 ft. instead of required 30 ft. <br />Betty P. Pious - special permit, pursuant to Section 25.15 (dwelling conversion to <br />two-family). The address of the property is 255 Bedford Street. The property <br />formerly contained the office of Dr. Pious (by special permit of the Board of <br />Appeals) and also part of the property was used as a residence. <br />Harry B. Dunn - variance from the provisions of Sections 26 and 27 of the Lexing- <br />ton Zoning By-law, and other applicable provisions, so as to allow for the con- <br />struction of a single family house on a lot containing 30,143 sq. ft., more or <br />less, said lot being located at the end of Leonard Road; said lot not having the <br />frontage on an accepted street as required by the provisions of the By-law. <br />George W. Pauff - variances of Section 27 with respect to property at 7 Boulder <br />Road; the land being parcels 57 and 58 with a frontage of 60 ft. and area of <br />5,770 sq. ft. <br />Hearings were not held in the order they appear here. The attorney represent- <br />ing the petitioners whose hearing was scheduled for 7:30 did not arrive on time. <br />If it is important that the scheduling be noted, they were held in the following <br />order: Dunn, Pious, Pauff, Little. No hearing was held before the time scheduled. <br />The Board made the following decisions, all in open public meeting: <br />Little - granted unanimously. <br />Dunn - granted unanimously subject to certain conditions: (1) The house shall be <br />set back at least 50 ft. from Leonard Road so that, if another "taking" is made and <br />Leonard Rd. is completed as an accepted street, it will have more than the required <br />30 ft. setback. (2) The construction of the house shall be started within one <br />year from date. (3) Water and sewer extensions from Leonard Road shall be at the <br />petitioner's expense. <br />Pious - denied unanimously. <br />Pauff - denied unanimously. <br />All pertinent material is on file in the Board of Appeals' office.
