BOARD OF APPEALS HEARINGS <br />October 2, 1975 <br />A regular meeting of the Lexington Board of Appeals was held on Thursday, <br />October 2, 1975 at 7:30 p.m. in the Selectmen's Meeting Room of the Town Office <br />Building. Present were the five regular members of the Board: Chairman Donald <br />E. Nickerson, Vice Chairman George P. Wadsworth, Ruth Morey, Woodruff M. Brod- <br />head, and Logan Clarke, Jr. Also present in addition to petitioners and/or <br />their attorneys, were a Lexington Minute -Man reporter, two representatives from <br />the League of Women Voters, and a room overflowing with townspeople. A request <br />from Sam Silverman to be allowed to tape the hearings was granted. <br />Public open hearings were held on the following petitions, notice having <br />been mailed as required by law to abutters, etc. and to town boards and officials. <br />Notices were published in the Lexington Minute -Man newspaper as required. See <br />copies of the permits and denials which were issued for more details. <br />Francis H. Bussey - variance of the Lexington Zoning By-law, Section 27, to build <br />a pool on his property at 12 Bowker Street with a rear yard of 10 ft. instead of <br />the required 15 ft. <br />Robert and Paul Mammola - special permit, pursuant to Section 25.69, to serve <br />food at Rosina's Kitchen Deli on the street floor of the building at 363A Massa- <br />chusetts Avenue. Rosina's Kitchen is owned and operated by Robert and Paul <br />Mammola. <br />Anthony R. Cataldo - renewal of special permit to continue to process and sell <br />fruits and vegetables at premises located at Gold Ribbon Farms, 1265 Massachu- <br />setts Avenue. <br />F. William Smith - for variances with respect to his property at 1009 and 1037 <br />Massachusetts Avenue: (1) from Section 26 of the Zoning By-law to allow three <br />one -family dwellings and four two-family dwellings to be located on a lot con- <br />taining more than 108,500 square feet of land and located in a Two-family Dwell- <br />ing (RT) District, and (2) from Section 25.80 to allow an accessory garage build- <br />ing containing parking spaces for four automobiles to be located in a Two-family <br />Dwelling (RT) District. <br />Following the hearings the Board made the following decisions, all in open <br />public meeting: <br />Bussey granted unanimously. <br />Mammola - granted unanimously "to sell delicatessen -type products at Rosin's <br />Deli on the street floor of the building at 363A Mass. Ave. according to draw- <br />ing submitted, permitting the use of 11 tables each accommodating 3 people, sub- <br />ject to conditions: (1) All cooking will be done during the morning hours 8:30 <br />- 11 a.m. and the food kept warm by means of steam tables or heated by radar <br />range. (2) No more than eleven tables may be used, each to accommodate 3 people. <br />(3) The hours of operation shall be from 9 a.m. to 6:30 p.m., 7 days a week. <br />(4) There will be no obtrusive signs displayed. <br />Cataldo - granted unanimously with the 8 conditions imposed by previous permit. <br />F. William Smith - granted on a vote of 4 to 1. See permit for conditions, etc. <br />All pertinent material is on file in the Board of Appeals' office. <br />The meeting adjourned at 11:30 p.m. <br />Evelyn F.
