BOARD OF APPEALS HEARINGS <br />May 22, 1975 <br />A regular meeting of the Lexington Board of Appeals was held on Thursday, <br />May 22, 1975 at 7:30 p.m. in the Selectmen's Meeting Room of the Town Office <br />Building. Present were five regular members: Chairman Donald E. Nickerson, <br />Vice -Chairman George P. Wadsworth, Ruth Morey, Woodruff M. Brodhead and Logan <br />Clarke, Jr. Also present were a Minute -Man reporter and a room full of towns- <br />people as well as the petitioners or their representatives. <br />Public hearings were held on the following petitions, notice having been <br />mailed to abutters etc. as required by law and also advertised in the Lexington <br />Minute -Man and notice was given to town boards and officials. <br />William P. Antonucci - variance of section 27 to install an inground swimming <br />pool in the rear of the existing building at 16 Green Lane with a side yard of <br />10 ft. instead of the required 15 ft. <br />Willie Smith. Jr. and Geraldine G. Smith - variance of section 27 to build a <br />kitchen addition to the existing house at 10 White Pine Lane which will have a <br />6'8" side yard instead of the required 15'. <br />Charles Dinis - special permit under Section 25.69 of the zoning by-law to use <br />the premises at 46 Massachusetts Avenue for the serving of food. The petitioner <br />is a Lessee of the premises. <br />The 115 Kendall Corporation - special permit pursuant to.section 12 and related <br />sections with respect to the property located at 29 Hartwell Avenue.; (1) pro- <br />posed second floor addition for the installation of mechanical and electronic <br />equipment, and (2) a new enclosed stairway leading from first floor to second <br />floor addition. The present tenant is Data Resources, Inc. <br />Gordon E. Barnes, Jr. - variance of section 27 to build an addition at 11 Ewell <br />Avenue with a side yard of 11 ft. instead of the required 12 ft. and a front <br />yard setback of 29 ft. instead of the required 30 ft. <br />Following the hearings the Board made the following decisions, all in open <br />public meeting: <br />Antonucci - denied unanimously. <br />Dinis - denied unanimously. <br />Smith - granted (4 to 1, George P. Wadsworth voting in the negative). Permit is <br />subject to agreed plantings after construction and that no mechanical earth -moving <br />equipment be involved in the construction. <br />Kendall - granted unanimously. <br />Barnes - granted unanimously. <br />All pertinent material is on file in the Board of Appeals' office.
