BOARD OF APPEALS HEARINGS <br />January 2, 1975 <br />A regular meeting of the Board of Appeals was held on Thursday, January 2, <br />1975 in the Selectmen's Meeting Room of the Town Office Building at 7:30 p.m. <br />Present were: Chairman, D. E. Nickerson; Vice Chairman, G. P. Wadsworth; <br />regular members: W. Brodhead and Ruth Morey; and associate member, Robert M. <br />Gary. Also present were: Petitioners or their representatives, newspaper <br />reporters, League of Women Voters observers, and a room full of townspeople. <br />Public hearings were held on the following petitions, notice having been <br />mailed to the petitioners, to the owners of all property deemed by the Board to <br />be affected thereby as they appear on the most recent local tax list, to town <br />boards, and also advertised in the Lexington Minute -Man. <br />All hearings and decisions were made in open public hearing with specta- <br />tors present. <br />Henry and Natalia Stojanow - variance of section 27 to maintain the existing <br />dwelling at 8 Essex Street with a side yard of 7 ft. instead of the required <br />10 ft. on the easterly side of the premises. <br />Moore Homes, Inc. - to vary sections 25.10 and 25.11 of the zoning by-laws of <br />the Town of Lexington to allow two-family dwellings to be built on Lots 1, 2, <br />3, 4, 5, 12, 13, and 14 with access from Bedford Street between numbers 75 and <br />77 Bedford Street. The lots are shown on a plan entitled Centre Estates Sec- <br />tion 2, dated Oct. 18, 1974, drawn by Miller & Nylander, Civil Engineers and <br />Surveyors, Lexington, Mass. Said lots are located in an RO one -family dwelling <br />zoning district. (RO should be RS) <br />SM Realty Corporation, 1-5 Forbes Road, Lexington - (1) A finding and determina- <br />tion pursuant to Section 13 of the zoning by-laws that the buildings, parking <br />areas, drives and other improvements shown on the site plan submitted will con- <br />stitute a suitable development and will not result in a substantial detriment to <br />the neighborhood. (2) A special permit pursuant to Section 12.2 of the zoning <br />by-laws to allow the construction of the buildings shown on plans submitted, to <br />be used for the purposes set forth in Sections 25.40, 25.41, 25.42 and 25.71 of <br />the Use Regulation Schedule. (3) A variance pursuant to Section 12.3 of the <br />zoning by-laws to allow: (a) the construction of Building B shown on plans sub- <br />mitted, which building has a rear yard of less than 100 ft. abutting an RO dis- <br />trict (closest point to Building B is 30 ft. from RO district) and a front yard <br />of less than 100 ft. abutting Forbes Road (closest point of Building B is 75 ft. <br />from road), which conditions vary from Section 27, Schedule of Dimensional Con- <br />trols; (b) the use of 14 parking spaces servicing Building B which are located <br />within 50 ft. of an RO district in variance with Section 32.2, Schedule of Dim- <br />ensional Restrictions for Parking and Loading; and (c) the design of parking <br />spaces having a 9 -foot width in variance with definition of parking space in <br />part 4. <br />The Petitioner proposes to build two buildings (designated as Building A <br />and Building B on the site plan submitted, dated 12/9/74) on its property located <br />on the westerly side of Forbes Road containing 5 46 acres of land. Building A, <br />a multi-purpose office/laboratory building will initially contain 30,000 sq. ft. <br />and may be expanded to contain up to an additional 10,000 sq. ft. Building B. a <br />multi-purpose office building, will contain up to 20,000 sq. ft. <br />Attached to the petition is a copy of a Certificate of Completion issued <br />by the Massachusetts Department of Natural Resources regarding the completed site <br />
