BOARD OF APPEALS HEARINGS <br />I <br />December 18, 1973 <br />A regular meeting of the Lexington Board of Appeals was held on Tuesday, <br />December 18, 1973 at 7:30 p.m. in the Selectmen's Meeting Room of the Town <br />Office Building. Present were Chairman Nickerson, Vice Chairman Sheldon, <br />regular members W. Brodhead and R. Morey, associate member Robert M. Gary, a <br />Minute -man Publications' reporter, a League of Women Voters' observer and an <br />audience of townspeople. <br />At the beginning of this meeting a photograph was taken for the Annual <br />Town Report. <br />Public hearings were held on the following petitions, notice having been <br />mailed to the petitioners, to the owners of all property abutting the petition- <br />er's land and to all abutters of the abutters as they appear on the most recent <br />local tax list, to town boards and officials who will or might be affected by <br />decisions made and also advertised in the Lexington Minute -man newspaper. <br />Follen Church Society - permission, as required under section 25.34 of the <br />Lexington zoning by-law, to sell Christmas trees on the premises at 764 Massa- <br />chusetts Avenue. <br />Sun Valley Farms, John and Rosina Busa - permission, as required under section <br />25.34 of the Lexington zoning by-law, to sell Christmas trees and wreaths on <br />the premises at 52 Lowell Street. <br />Emilio Lyons - variance from the Lexington zoning by-law to build a pool 20 ft. <br />by 40 ft. which will have a front yard setback of 21 ft. instead of the required <br />30 ft. The easement going through the yard on this property at 4 Hickory Street <br />does not allow for placement of the pool in any other direction. The small <br />house which is behind the proposed pool is on a foundation and has flagstone <br />patios around it. <br />Middlesex Hellenic Orthodox Association (St. Nicholas Greek Orthodox Church) - <br />permission to build an addition to the existing non -conforming building at 17 <br />Meriam Street which will have insufficient side yard. <br />Trustees of Lexington Office Center Trust, Boston, Mass. (Cabot, Cabot, & Forbes) <br />- reference is made to Petition of the undersigned dated September 15, 1972 and <br />Board of Appeals' Permit and Finding and Determination granted October 17, 1972 <br />and Petition of the undersigned for Variance from the Lexington Building By -Law <br />and Board of Appeals Permit therefor granted November 28, 1972, said Finding <br />and Determination and said Permits having been granted after hearings duly held <br />and persons entitled to notice properly notified, except certain abutters to <br />abutters of the premises in favor of which said Permits and Finding and Deter- <br />mination were granted as required by General Laws, Chapter 40A, Section 17. <br />Accordingly, in order to afford such parties proper notice, the undersigned <br />hereby repetitions the Lexington Board of Appeals appointed under the General <br />Laws, Chapter 40A, Section 13 to 19 as amended, for the followingiPermits and <br />Variance as previously granted: (a) a Special Permit (Sec. 12.2 of the Lexing- <br />ton Zoning By -Laws) permitting the construction and use by Honeywell Radiation <br />Center of the premises shown on the Site Plan enclosed, (b) a Finding and Deter- <br />mination that the 18,070 square foot (2 -story Building) located on a 15.2 acre <br />
