71 <br />BOARD OF APPEALS HEARINGS <br />October 1$, 1955 <br />A meeting of the Board of Appeals was held in the Selectmen's <br />Room, Town Office Building, on Tuesday October 18, 1955• <br />At 8:00 p.m. hearings were declared open on the following <br />petitions: <br />Mary E. Dacey - to operate a kindergarten for ten children, 4 <br />and 5 years of age, five mornings a week from 9 a.m. to 11:45 .m. at <br />Winchester Dr. <br />Persis L. Ballou - to operate a scheduled play group for not more <br />than ten children at er residence 2013 Mass. Ave., said group to be <br />operated in the forenoon, not more than three days a week. <br />Mrs. Harry W. Cram - to operate a pre-primary school for not more <br />than ten children etween the ages of 2 and 5-1/2 years at 759 Waltham <br />St. five days a week from 9 a.m. to 4:30 p.m. the year round. <br />Benjamin J. Gott - to erect a single family dwelling on Lot 19 <br />located on Sylvia St., which will be set back from the street 20 feet <br />instead of 30 feet as required under the zoning by-law. <br />Garrett B. Fuller - to relocate the lot line between Lot l and <br />Lot 2 on Hayes Ave. <br />John Bresnihan - to erect a two -car garage on Lot #44 at the <br />corner of WoodSt. and Holt n Rd. which will be set back from Holton <br />Rd. 14 feet instead of 20 feet as required by the Zoning By-law. <br />Alexander MacMillan - to convert the building at 23 Sylvia St. <br />into a two-family ouse, substantially in accordance with the plans sub- <br />mitted, such renovations to be satisfactory to the Building Inspector. <br />First Congregational Society in Lexington - This case was taken <br />to Court and the variance declared null and void. A new hearing was held <br />on October 18, 1955 for a special permit under paragraph 7, Sec. 5 (a) <br />sub -paragraph f. The decision on this hearing was held over to November <br />1, 1955. A meeting was called for November 1, but owning to the inability <br />of the original members of the Board b meet on this date, it was post- <br />poned until November 14. At the meeting of the Board held on November 14 <br />three members having voted in favor and two in opposition the petition of <br />the First Congregational Society (Unitarian Church) for permission to use <br />the parking area shown on plan of land submitted and to remove loam from <br />said parking area was automatically denied. <br />At the close of the hearings an executive session was held during <br />which the following decisions were rendered: <br />Mary E. Dacey - granted, subject to the following conditions: (1) <br />that not more than 10 children shall be in attendance at any one time. <br />
