208
BOARD OF APPEALS MEETING
'
OCTOBER 9, 1836.
A meeting of the Board of Appeals was held in the Select-
men's Room, Town Office Building, at 8:00 P. M. Messrs.
Ferguson, Glynn, and Kimball were present. Mr. Robbins was
detained and appeared after the hearing was declared closed.
The Secretary was also present.
In the absence of Mr. Maddison, Mr. Glynn acted as ;hairman,
and in the absence of Mr. Robbins, Mr. Kimball acted as Clerk.
At 8:00 P. M. hearing was declared open on the application
of Augustus J. Silva for permission to enlarge the existing
roadside stand at 643 Waltham Street, Lexington.
Mr. James Spellman stated.that he was going to speak in
favor of the petition for Mr. Silva, who also was present.
Spellman said that for some years Mr. Silva had been engaged in
farming and had a small stand called the Step-in for fourteen years.
This stand has proved too small because of his raising more
vegetables now. Spellman said that the stand was in harmony
with the existing buildings and that he planned to enlarge it
about thirty feet, making the total length about fifty feet.
Silva has a frontage of 500 feet on Waltham Street and plans to
have the stand about twenty feet back from the road in order
to allow cars to drive in. Mr. Spellman presented a plan of
'
the proposed stand. He said that at the present time Silva
is forced to leave his squash and other vegetables against the
fence and has to cover them at night, which is quite a task.
He thought the enlargement of the stand would prove an asset to
the property. He has about six acres of land and raises all
his own vegetables. He thought that the enlargement of the
stand would not increase the hazard. He said that the neighbors
had no objection and in fact, approved of the enlargement.
Mr. James J. Lima of 634 Waltham Street and Miss Annie T.
Carroll of 676 Waltham Street stated that they were in favor of
the enlargement of the stand.
The Chairman asked where the stand was located and Mr.
Spellman said that it was located on Waltham Street opposite
Allen Street.
The Chairman asked if the present stand was twenty feet
back from the street line and he replied in the affirmative.
The Chairman asked the size of the present stand and Mr.
Spellman said that it was 12 feet long, 10 feet wide, and
8 feet high.
The Chairman asked if Mr. Silva understood that he could
sell only produce grown on the premises and Mr. Spellman said
that he did.
Miss Carroll said that the stand that Mr. Silva now main-
tained was neat and clean and she thought the one he wanted to
erect would be maintained in the same manner.
'
Mr. Lima stated that he had known Mr. Silva for a number of
years and that he was a reliable and law-abiding citizen.
No persons appeared in oppgsition.
