42-6 <br />The Board told him that they would advise him on <br />the matter and he and Mr. Lyons retired. <br />The Chairman read the Health Inspector's report <br />' <br />which stated that the henhouse was kept clean and in a <br />sanitary condition. The nearest residence is about 300 <br />feet away and he thought it could not be affected by <br />any odor. There are about 15 roosters which he <br />thought would make a lot of noise when they all started <br />crowing. The Health Inspector called the crowing of the <br />roosters a nuisance but stated that there was no health <br />menace. <br />The Town Counsel stated that if the neighbors= -did <br />not approve of the Board's decision on the health menace, <br />they had recourse to the Courts. He t6ld the Board <br />that they could advise Bidwell that there was no health <br />menace. <br />Mr. Giroux moved that Roberts be advised that he <br />would be given thirty days from April 15th in which to <br />dispose of his roosters in order to comply with Article <br />26, Section 1 of the Town By-laws. Mr. Potter seconded <br />the motion and it was so voted. Mr. Giroux moved that <br />the Selectmen advise Bidwell of"the Board's decision. <br />Mr. Potter seconded the motion and it was so voted. <br />At 8;30 P.M. Town Engineer Cosgrove appeared before <br />the Board. The Chairman told him that the Board was <br />disturbed about the method he used in getting signatures <br />on the petition for the construction of Tower Road and <br />' <br />the method of handling the construction of the street <br />itself and the fact that he did not arrange for the <br />construction of the road past his vacant lot. Mrs <br />Cosgrove stated that the layout as presented to the Town <br />Meeting was the result of three petitions. A. Mrs. <br />Simonds of Plymouth Road presented a request containing <br />the signatures of persons living on Plymouth Road and <br />Cosgrove told her that it was not the Board's procedure <br />to construct streets unless they connected with another <br />street that has already been constructed. A.petition <br />was presented for the construction of Tower Road from <br />Mass. Avenue to Richard Road and then Mr. Grush asked <br />to have the street in front of his house constructed,, and <br />this made a difference of 40 feet to Cosgrove, but it <br />did not bother him. He stated that it was not his prac- <br />tice to go beyond the petition as presented to him. <br />Cosgrove's share of the betterment on the first libt <br />was $420.00 and it would be $350, for the second lot, <br />and if it were not for this fact, he probably would <br />have contacted the bank. The Chairman stated that the <br />Selectmen would be criticised for placing the vote to <br />the Town in the manner in which they did leaving out one <br />house and not giving the Bank an opportunity to act on <br />the matter. The bank thought that the reason for this <br />' <br />was that Cosgrove was interested and they were not given <br />an opportunity to express any opinion in the matter. <br />J Mr. Cos trove stated that at the time if it had been a <br />
