<br />PLANNING BOARD MINUTES <br />MEETING OF APRIL 13, 2009 <br /> <br />A regular meeting of the Lexington Planning Board in the Planning Office, Town <br />Office Building was called to order at 6:05 p.m. by Chairman Hornig, with members <br />Manz, Canale and planning staff McCall-Taylor and Henry present. Mr. Zurlo joined <br />the meeting in process and Mr. Galaitsis was absent. <br />*****************************TOWN MEETING************************** <br />Article 47- The Board reviewed the draft report and on a motion duly made and <br />seconded, voted 3-0 to approve the version that included Ms. Manz’s edits. <br />Article 48 – The Board on a motion duly made and seconded, voted 3-0 to approve the <br />report on Article 48 as amended. <br />Articles 44- 46 - The consolidated motion for Articles 44-46 was discussed. It was <br />noted that the purpose section had been deleted. It will be put back in, as will the town <br />counsel’s suggested wording regarding when overlay districts supercede the underlying <br />district. Mr. Hornig said that if any of the three motions fail the Board would not try to <br />move forward with implementation as they are an integrated whole. The provision <br />allowing the waiver of dimensional standards by special permit was discussed. Mr. <br />Canale wanted to know what would warrant a waiver and indicated that there should be <br />a policy with standards and procedures; perhaps it could be in the Development <br />Regulations. Mr. Hornig suggested having the special permit granting authority make a <br />determination that it complied with the site plan review standards. Mr. Zurlo joined the <br />meeting. Mr. Canale said that in §135-13.1C(3) the “may” should be changed to <br />“shall”. The other members agreed. Mr. Zurlo said that the standards for special permit <br />approval should be consistent with §135-12. <br /> <br />At 6:45 the Board joined the Board of Selectmen’s meeting. Mr. Hornig gave a brief <br />presentation on Articles 44-46. The Board of Selectmen had some questions and <br />indicated that they would not take a position on the articles until they received the <br />Planning Board’s report. Mr. Hornig said the report would be available by Friday. <br />The Selectmen asked about the other zoning articles. Mr. Hornig said that the Planning <br />Board was opposing Article 48 based on the public hearing presentation but expected <br /> <br />
