Wit] <br />ILTEETIr G, Jt-ZUARY 22v 1924. <br />ri regular meeting of the Board of Selectmen was held in <br />the Selectmen's Room, sown Fall, Lexington, on Tuesday, <br />January 22, 1924, at 8:00 F. :v. 1he following members of the <br />Board were present; namely: Ileacre. Scammar, Blake, Hutchinson, <br />3urnham and :oulton; the Town clerk, the Asst Town Clerk, and <br />the Town Counsel were also present. <br />isir.'Theodore A. Custance came before the Board in respect <br />to the hearing upon his application to put an addition on to the <br />present carpenter shop he maintains at Bedford atreet. <br />The 'Town counsel maintained that this shop constituted a <br />factory and that a hearing was, therefore, necessary. <br />No persons appeared to object and the permit for same was <br />therefor granted by the Building Inspector. <br />ser. Joseph Trani again came before the Board in reference <br />to building his :More. he stated that he could nit get anywhere <br />with kr. Emery in his conference with him. <br />yr. :Slake suggested that ter. Robert r. Clapp'e legal opinion <br />be obtained as to whether or not the Board and Building Inspector <br />had any right to hold up this permit pending action of the town <br />on the zoning; system. <br />.u:r. Scanman and kr. Loulton felt that someti-Ang should be <br />done as ivir. Trani hap apulied for the permit. <br />The Building inr?pector felt that :dr. Trani would go ahead <br />vrith the building if he did not get the permit, and he felt he <br />had a right to do so as he has complied with the Building Lawp. <br />Totem Counsel advised the Building Inspector that he could <br />place an injunction on Trani to restrain him from building. <br />It was finally decided to ask Lr. Clapp for his expert <br />opinion in accordance v.>ith the buildir_g regulations, and to have <br />same in by Tueec'_ay next so that i1`_r. Trani would not bF held up <br />any loner than possible. <br />%r. John H. F eeaion of the Vieptern tuaterproofing Company <br />came before the Board with reference to payment of $800 per year <br />which he claims was due him under the guarantee to keep the stand- <br />-ipe waterproof. He claimed that the old Board of slater A- Sewer <br />Oommisaioners would not bring up this technicality ae it was with <br />' <br />them that this agree:ent war made. <br />The 'Iozn Uounsel felt that he war not legally entitled to <br />this amount under the guanantee, but if the former members of the <br />'Vater Board vould sign a statement that under the agreement <br />between them and the ureetern aterproofing Company the comp:-.ny was <br />entitled to the payment, then he would think perhaps in fairness <br />the .Board would be justified in making some compromise. <br />Tr. lepsion stated that ter. Harrison held up the bill because - <br />no work had been done in 1922. he said the reason nothing wap donA <br />waft that the tank was not emptied until november and he informed <br />the Jupt. that he would not do any work so late in the reason <br />
