<br />COMMUNITY PRESERVATION COMMITTEE <br />Executive Session <br />Legion Room, Cary Memorial Hall <br />Thursday, April 3, 2008 <br />4:00 p.m <br />. <br /> <br /> <br />Present: <br /> Betsey Weiss, Chair; Joel Adler, Norm Cohen, Marilyn Fenollosa, Richard <br />Pagett, Judy Pearson, Sandy Shaw, Dick Wolk. <br /> <br />At 4:20 p.m. a motion was made and supported unanimously by roll call vote for the <br />Community Preservation Committee to go into Executive Session with intent to return to <br />open session. The purpose of the Executive Session was to discuss a matter of litigation. <br /> <br />The Committee was asked to join with other municipalities in filing an amicus brief in <br />support of the City of Newton’s appeal of a Superior Court decision holding that CPA <br />funds could not be used to reconstruct a playground that was not originally funded by <br />CPA funds. The legal costs were estimated to not exceed $7,000. It was the consensus <br />of the CPC to not use administrative funds for this purpose. <br /> <br />Following this discussion, a motion was made and supported unanimously by roll call <br />vote to go out of Executive Session and return to open session at 4:30 p.m. <br /> <br />Respectfully Submitted, <br /> <br />Judy Pearson <br />Administrative Assistant to the CPC <br />J.
