August 1, 2017 Turning Mill NCD Study Committee Meeting Minutes <br />Committee Attendees: Diane Pursley, Richard Canale, Linda Wolk, Bob Creech (Sally Cassells Absent) <br />Other Attendees: Donna Moltrup, Tina McBride <br />A) Schedule/Calandar <br />1) The Turning Mill and Byron Ave Study Committees will be on the Agenda for the August 30 Planning Board <br />meeting. Each Study Committee will give a 5 minute presentation: <br />a. What has the Study Committee done <br />b. A Progress report <br />c. Answer questions from the Board <br />2) The Bylaws will be submitted to Town Counsel in early September <br />3) The NCD Study Committees will vote to accept the Study Committee reports in mid September <br />4) The mailing to all property owners in the proposed NCD Area(s) and public hearing notice will go out in early <br />October with the final Study Committee report available for review. <br />5) The joint Planning Board/Historic Commission Public Hearing will be on November 1. <br />a. A 10 to 15 minute presentation by the Study Committee <br />i. Turning Mill will present <br />ii. Byron Ave will present <br />b. The meeting will end with two votes by the Joint Boards. Unless something we haven't heard before <br />from the public comes up during the meeting <br />6) November 29 (the Wednesday before Dec. 1) is the deadline for redrawing the NCD Area (per the enabling <br />bylaw, the follow-up joint meeting to incorporate changes in the NCD Area based on the opt -outs received is <br />30 days.) The opt -out deadline will be the November 22, the Wednesday before Thanksgiving <br />B) Proposed Language for Enabling Bylaw regarding overlapping of HC and NCD <br />a. The purpose to avoid homeowners subject to both HC and NCD review as we transition from HC to NCD <br />Commission jurisdiction. <br />i. It was preferred that we use the Process Chart and an effective date instead of writing this one- <br />time only set of rules into the enabling bylaw <br />ii. We will explain this to Town Counsel and ask him how to deal with the transition. <br />C) Turning Mill NCD Bylaw interaction with the Tree Bylaw: There was consensus that the NCD bylaw as proposed <br />and the Tree bylaw would co -exist. The NCD Commission would approve a landscaping plan, which would cover <br />the entire lot. As a separate process, the property owner would work with the Tree Warden to determine the <br />setback trees, the removal, replanting and resulting fees (if any). Diane and Bob are meeting with the Tree <br />Committee on August 10 and will talk this proposal with them and get feedback. <br />D) Chapter 19 (Demolition Delay Bylaw): If the NCD is approved, the NCD properties will be exempt from the <br />Demolition Delay bylaw which is administered by the Historic Commission. The Planning Board is proposing a <br />change to Chapter 19 for adoption at Fall Town Meeting. The public hearing for this proposed change will be <br />held in mid-September. <br />E) Conservation Commission: What if the NCD Commission approves a plan but Conservation Commission input is <br />required because of the proximity to wetlands? This issue will be added to the log and Diane will do some <br />research on the wetlands documented on the GIS system in the neighborhood today. <br />F) Map: Diane will contact David Kucharsky regarding the PDF of the Proposed NCD Area for TM. <br />G) Chapter 1— 6: Non -criminal Disposition: If there are any fines, they will be issued by the Building Commissioner <br />and not by the NCD Commission so changes to this bylaw are not necessary. <br />
