PLANNING BOARD MINUTES <br /> F' MEETING OF APRIL 28, 1993 <br /> The meeting of the Lexington Planning Board was held with the Board of <br /> Selectmen in the Selectmen's Meeting Room, Town Office Building The joint <br /> meeting was called to order by Selectmen Chairman, William Dailey, at 6 45 <br /> p m. Chairman Williams and members Canale, Davison, Domnitz, Grant, and <br /> Planning Director Bowyer were present. <br /> ************************ EXECUTIVE SESSION ********************************** <br /> 63. Litigation against the Planning Board and the Town On the motion of <br /> Mr. Grant, and after a poll of the individual members, the Planning Board <br /> voted unanimously to go into joint Executive Session with the Board of <br /> Selectmen to discuss litigation against the Planning Board and the Town. <br /> After the Executive Session, the meeting of the Lexington Planning Board was <br /> resumed in Room G-15, Town Office Building, at 7 37 p.m by Chairman Williams <br /> with members Canale, Davison, Domnitz, Grant, Planning Director Bowyer, and <br /> Assistant Planner Marino present. <br /> *********************** ARTICLES FOR 1993 TOWN MEETING *********************** <br /> 64 Article 30. Locke Village Mr. Kelley of Woodhaven Realty and Gary <br /> Larson of Larson Associates were present. Mr Larson said the three buildings <br /> in the revised plan were about 10 feet shorter and the footprint was propor- <br /> tionately smaller. <br /> Mrs. Davison asked whether they would maintain the offer to donate seven units <br /> to LEXRAB. Mr Kelley said that the economics of the development dictated <br /> that the percentage of units be maintained at 10 percent (6 units). <br /> Mr. Williams hoped that the reduction of site coverage would permit larger and <br /> better designed areas for passive recreation. <br /> Mr. Domnitz questioned language in the Preliminary Site Development and Use <br /> Plan that makes the development subject to the 1992 Zoning By-Law Mr. Bowyer <br /> explained that is standard language that has been in every Preliminary Site <br /> Development and Use Plan since 1985 It is included to avoid confusion that <br /> might be created from other zoning amendments pending in the same Town <br /> Meeting The applicant is required to file a complete Preliminary Site <br /> Development and Use Plan by the second Monday of January. The applicant can <br /> not continually adjust to other proposed zoning amendments that are being <br /> developed and conceivably be amended on the floor of the Town Meeting <br /> Another reason is to provide some assurance to lenders that the proposal is <br /> "anchored" to one specific zoning by-law without being subject to change. <br /> Neighbors Frank Kirkland and Paul Bongiovanni were present. Both said that 52 <br /> dwelling units would be acceptable to them Mr Bongiovanni said he would <br /> support the proposal if the applicant would construct a sidewalk along North <br /> Street from the emergency drive and along Lowell Street Mr. Kelley said he <br /> could not commit to the expense of that construction so late in the process <br /> �J when the economics of the proposal have changed as much as they have. Mr <br /> Williams noted abutters would be affected. <br />
