Minutes of the Lexington Zoning Board of Appeals <br />Virtual, Via Zoom <br />June 9, 2022 <br /> <br />Board Members: Chair – Ralph D. Clifford, Jeanne K. Krieger, Norman P. Cohen, Nyles <br />Barnert and Martha C. Wood <br /> <br />Alternate Member: James Osten <br /> <br />Administrative Staff: Julie Krakauer, Zoning Administrator and Sharon Coffey, Administrative <br />Clerk <br /> <br />Address: 1764 Massachusetts Avenue <br /> <br />The petitioner is requesting a SPECIAL PERMIT in accordance with the Zoning By-Law <br />(Chapter 135 of the Code of Lexington) section(s) 135-9.4 and 135-3.4 (Table 1 Permitted Uses <br />and Development Standards) Line J.1.02 of the Zoning Bylaw (Chapter 135 of the Code of <br />Lexington) to allow fast food use in the CB Zoning District <br /> <br />The petitioner submitted the following information with the application: Nature and Justification <br />and floor plans. Also submitted was a certified plot plan waiver request. <br /> <br />Prior to the meeting, the petitions and supporting data were reviewed by the Building <br />Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Planning <br />Director, the Historic District Commission Clerk, Historical Commission, Economic <br />Development, and the Zoning Administrator. Comments were received from the Zoning <br />Administrator, Building Commissioners and Economic Development. <br /> <br />Presenter: Jeffrey Lin on behalf of Coco Fresh Tea & Juice <br />The Hearing was opened at 7:16 pm. <br />Mr. Lin presented the petition. He reviewed his business. He stated he did not request seating <br />when they opened due to the pandemic. They are requesting seating of 6 seats. They want to <br />create an engaging area for people to hang out and create a sense of community. The proposal <br />will no affect traffic or parking. He showed the floor plan. <br />A Board Member, Nyles N. Barnert, questioned the hours of operation (10 am to 9pm, 7 days a <br />week). <br />Chair, Ralph D. Clifford, questioned if they have any current Special Permits (This is their <br />Special Permit request. Take out is allowed by-right). <br />There were no questions or comments from the audience. <br />There were no further questions from the Board. <br />Mr. Lin stated they enjoy their time in Lexington and look forward to continuing to serve in <br />Lexington. <br />The Hearing was closed at 7:24 pm (a role call was taken: Ralph D.
