Minutes of the Lexington Zoning Board of Appeals <br />Virtual, Via Zoom <br />May 12, 2022 <br />Board Members: Chair – Ralph D. Clifford, Jeanne K. Krieger, Norman P. Cohen, Nyles <br />Barnert and Martha C. Wood <br />Alternate Member: Kathryn Roy <br />Administrative Staff: James Kelly, Building Commissioner, Julie Krakauer, Zoning <br />Administrator and Sharon Coffey, Administrative Clerk <br />Address: 45 Fottler Avenue <br />The petitioner is requesting a SPECIAL PERMIT in accordance with the Zoning By-Law <br />(Chapter 135 of the Code of Lexington) section(s) 135-9.4 and 135-8.4.2 to allow modification to <br />non-conforming structure. <br />The petitioner submitted the following information with the application: Nature and Justification, <br />Plot Plan, Plans, Elevations and Gross Floor Area Calculations. <br />Prior to the meeting, the petitions and supporting data were reviewed by the Building <br />Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Planning <br />Director, the Historic District Commission Clerk, Historical Commission, Economic <br />Development, and the Zoning Administrator. Comments were received from the Zoning <br />Administrator, Conservation Administrator, Engineering Department, Building Commissioners <br />and Planning Department. <br />Presenter: Paul Kirchner, engineer at 100 Main St Acton Ma, on behalf of Marina and Igor Balk <br />Mr. Kirchner stated the Conservation hearing was closed. They addressed the Town Engineers <br />issues with the Storm Water Management System and also the owner is going cease <br />encroachment of their yard onto the adjacent parcel owned by the Town of Arlington. <br />Chair, Ralph D. Clifford, questioned if the 8 feet from the house matches the window that is in <br />the house (The placement of the garage was in an effort to maintain existing setbacks. The <br />window was taken into consideration). <br />Alternate Member, Kathryn Roy, questioned if there were any encroachments in the setbacks <br />(They requested the Special Permit because the proposed and existing garage are in the <br />setbacks at a minimum of 4.5 ft of the side lot line 21.2 feet to the front lot line. They have <br />maintained the front lot line and increased the side lot line to 5 feet). <br />There were no further questions from the Board. <br />There were no questions or comments from the audience. <br />The hearing was closed at 7:10 pm (a role call was taken: Ralph D. Clifford– Yes, Jeanne K. <br />Krieger – Yes, Martha C. Wood – Yes, Norman P. Cohen – Yes and Nyles N. Barnert – Yes). <br />The Board of appeals voted five (5) in favor, zero (0) opposed, and zero (0) in abstention to <br />grant a SPECIAL PERMIT in accordance with the Zoning By-Law (Chapter 135 of the Code of
