<br /> Commonwealth of Massachusetts Middlesex, ss.
<br /> To either of the Constables of the Town of Lexington, in said County:
<br /> Greeting:
<br /> In the name of the Commonwealth of Massachusetts, you are
<br /> directed to notify the inhabitants of the Town of Lexington,
<br /> qualified to vote in elections and in town affairs, to meet in the
<br /> Cary Memorial Build5ng, in said Lexington, on Thursday, the 10th
<br /> day of November, 1938 at eight o'clock P. M. , then and there to act
<br /> on the following articles:
<br /> Article 1, To receive the reports of any Board of Town
<br /> Officers or of any Committee of the Town and to appoint other Com-
<br /> mittees.
<br /> Article 2. To see if the Town will authorize the Selectmen
<br /> to enter into an agreement on behalf of the Town. of Lexington with
<br /> the Town of Arlington to provide co-operation between the two towns
<br /> in the matters of connection of sewers in Lexington with Town of
<br /> Arlington sewers, and the connection of sewers in Arlington with
<br /> Town of Lexington sewers, or take any action in relation thereto.
<br /> Article 3. To see if the Town will vote to establish as a
<br /> town way or accept the layout of as a town way, the rounded corner
<br /> of Charles Street at Taft Avenue, as laid out by the Selectmen,
<br /> and shown upon a certain plan on file in the office of the Town
<br /> Clerk, dated September 15, 1938, or take any action is relation
<br /> thereto.
<br /> Article 4. To see if the Town will vote to accept from the
<br /> Rotary Club of Lexington a gift of two direction sign boards, one
<br /> located on the Lexington Common and one on the Buckman Tavern
<br /> Grounds, or take any action in relation thereto.
<br /> Article 5. To see if the Town will vote to raise and appro-
<br /> priate a sum of money for the purpose of repairing damage to public
<br /> property and public ways caused by the recent storm; to determine
<br /> whether the money shall be provided for by borrowin under Clause
<br /> 9, Section 8, Chapter 44, General Laws, or by transfer from avail-
<br /> able funds in the treasury, or take any action in relation thereto.
<br /> Article 6. To see if the Town will vote to rescind so much
<br /> of the action taken under Articles 2, 4, ana 5 of the Warrant for
<br /> the Special Town Meeting held on April 25, 1938 as relates to the
<br /> borrowing of the sums of $15,000 . , $15,000., and $5,000. respect-
<br /> ively, for the construction of sewers, as follows : a trunk line
<br /> sewer from a point near the Arlington-Lexington line to Rindge
<br /> Avenue, and sewers in Bow Street, Rindge, Melrose, Rawson, Albe-
<br /> marle and Winn Avenues, conditioned upon agreements to be signed
<br /> by the abutters.
<br /> Article 7. To see if the Town will ratify an agreement made
<br /> by the Selectmen with Colonial Garage, Inc ., subject to the approval
<br /> of the town meeting, for the settlement of the petition for assess-
<br /> ment of damages for a taking by eminent domain brought by Colonial
<br /> Garage, Inc. against the Town, No. 108635 in the Superior Court
<br /> for the County of Middlesex by the payment of $2 650 . plus interest
<br /> from January 18, 1937, plus costs of court, and to provide for pay-
<br /> merit thereof by appropriation and transfer from available funds.
<br /> Article 8. To see if the Town will vote to appropriate a sum
<br /> of money to pay Harry B. and Ethel Osgood $55.00 for an award by
<br /> the Commonwealth of Massachusetts in settlement of all land and
<br /> grade damages on account of the construction of Bedford Street in
<br /> 1926, and pay for the same by transfer from available funds, or
<br /> take any action in relation thereto.
