8. Applicability of Bylaw. Dave P. and Town Counsel confirmed that unaccepted streets are <br /> on private property and are not considered town owned land. Therefore, the Bylaw only <br /> applies to setback requirements on these private lots. <br /> 9. Applicability of Bylaw Part 2. The Bowman School tree removals was the other topic of <br /> discussion with regards to the Bylaw. It was determined that 1. The Conservation <br /> Department has town jurisdiction not the DPW. 2. No town permission was granted for <br /> Eversource to remove the trees. 3. A potential fee of$50,000 - $100,000 for the removal <br /> of the trees is possible. 4. Continued conversations are occurring between the Town and <br /> Eversource to resolve the matter. <br /> 10. Mark Sandeen initiated a discussion on new sidewalk construction on Lincoln and Cedar <br /> Streets. Significant tree removal is slated for both sites with as much as 120 inches <br /> removed on Cedar Street. Gerry P., Mark S., Nancy S. and Gloria B. agreed to walk the <br /> sites and to determine if a possible solution exists to minimize tree loss while maintaining <br /> public safety. <br /> 11. Marty Kvaal monitored Planning Board meetings with regard to tree coverage impacts <br /> and issues. She brought to the Committees attention the 12 Summit Rd. development. <br /> 12. Nancy Sofen is in the process of establishing a working relationship with the Town's <br /> Permanent Building Committee as the Tree committee's liaison.
