<br />TOWN OF LEXINGTON, MASSACHUSETTS <br />CONSERVATION COMMISSION <br />MINUTES <br />Tuesday, October 22, 2013 <br />7:30 P.M. <br />Parker Room, Town Office Building <br />1625 Massachusetts Avenue <br /> <br /> <br />Chair Joyce Miller opened the meeting at 7:30pm in the Parker Room of the Town Office <br />Building. <br /> <br />Commissioners Present: Joyce Miller, Phil Hamilton, Stew Kennedy, Duke Bitsko (arrived at <br />7:33pm), Dick Wolk (arrived at 7:38pm), and Jane Warren <br /> <br />Commissioners Absent: David Langseth <br /> <br />Others Present: Karen Mullins, Conservation Administrator and Michelle Tassi, Community <br />Development Department Assistant <br /> <br />7:31 pm Hearing – NOI, 990 Waltham Street <br /> DEP# 201-912, BL 872 <br />Excavation of lead-based paint impacted soil within the 100-foot Buffer Zone to <br />Bordering Vegetated Wetland <br />Documentation: NOI Application 10/2/13 <br />Present for the Applicant: Bill Dailey, Sloane and Walsh, James Freehling, <br />Symmes Lifecare, Inc. and James Borrebach, OHI Engineering <br /> <br />Mr. Dailey gave a brief history of the property before it was acquired by <br />Brookhaven and the current proposal to remove the low level of lead soil. Mr. <br />Borrebach explained that there will be excavation and off-site disposal of <br />contaminated soil with low level lead concentrations. The Notice of Intent <br />identifies up to 5,000 square feet of temporary Bordering Vegetated Wetland <br />alteration to accommodate the lead removal. A fluorescent meter will be used on <br />site to determine lead levels and minimize disturbance of the wetlands. Mr. <br />Borrebach commented that lead impacted soils from lead paint are not subject to <br />clean up standards. There will be removal and stockpiling of 750 cubic yards of <br />soil, installation of a Filtermitt silt sock, and the trees will be worked around to <br />limit the removal. <br /> <br /> Comments from the Commission as follows: <br />Ms. Miller read Mr. Langseth’s comments regarding this proposal. Mr. Hamilton <br />asked the parameters for stockpiling. Mr. Borrebach replied that the soil will be <br />stored for 30-90 days on and covered by polyethylene sheeting. Mr. Kennedy <br />commented on the preferred location for stockpiling to be close to the house <br />demolition area. The applicant agrees and is willing to implement additional <br />erosion control measures to preserve existing trees. Mr. Bitsko questioned the <br />maximum depth of soil removal. Mr. Borrebach replied that the depth would be <br />no more than three feet based on clean up of an average lead concentration. Mr. <br />Hamilton suggested conditioning security to watch for vandalism of the soil <br />stockpiling. <br /> <br />
