<br />TOWN OF LEXINGTON, MASSACHUSETTS <br />CONSERVATION COMMISSION <br />MINUTES <br />Tuesday, January 3, 2013 <br />5:30 P.M. <br />Parker Room, Town Office Building <br />1625 Massachusetts Avenue <br /> <br /> <br />Chair Joyce Miller opened the meeting at 5:34 pm in the Parker Room of the Town <br />Office Building. <br /> <br />Commissioners Present: Joyce Miller, Jane Warren, Stew Kennedy, Duke Bitsko, Phil <br />Hamilton, and Dick Wolk <br /> <br />Commissioners Absent: David Langseth <br /> <br />Others Present: Karen Mullins, Conservation Administrator and Michelle Tassi, <br />Community Development Department Assistant <br /> <br />5:35 pm Banks Avenue, NOI, DEP# 201-858, BL 816 <br /> <br />Comments from the Commission as follows: <br />Mr. Hamilton stated that he is in favor of the project because it meets the <br />performance standards and it cannot be denied due to drainage issues from <br />other properties. Mr. Wolk disagreed with approving the project and <br />suggested that a letter be sent to the Selectmen to raise awareness about <br />the flooding that occurs in the area. Mr. Bitsko agreed that others should <br />be involved to help the area and the project meets the performance <br />standards. Mr. Kennedy agreed that a letter should be written to the <br />Selectmen and he will approve the project. Ms. Warren agreed to approve <br />the project and commented that the area needs help with flooding. Ms. <br />Miller agreed with all the comments that were made. Mr. Bitsko suggested <br />that an infiltration test be done before the chambers are put in. Mr. Wolk <br />mentioned that a sump pump will not be allowed without written consent <br />from the Conservation Commission. Ms. Mullins read special condition <br />number 2. <br /> <br />Motion made and seconded to approve the project as most recently <br />proposed and to issue an Order of Conditions with special conditions for <br />Banks Avenue: DEP# 201-858, BL 816, 5-1 in favor. Mr. Wolk voted not <br />to approve the project as most recently proposed. <br /> <br />5:55 pm Motion made and seconded to approve the project as most recently <br />proposed and to issue an Order of Conditions for Route 2 MassDOT: <br />DEP# 201-879, BL 837, 6-0 in favor. <br /> <br />
