<br /> <br />MEETING MINUTES <br />NOISE ADVISORY COMMITTEE <br />9 SEPTEMBER 2008 <br />A duly posted meeting of the Noise Advisory Committee (NAC) held in the Legion <br />Room, Cary Hall, was called to order at 7:30 pm by Chairman Tony Galaitsis with <br />members Julian Bussgang, Martha Wood, Robert Earsy, Jack Maloney, Ted Page present. <br /> <br />Topic of possible changes to bylaw. <br />1. <br />??After some initial discussion, the NAC agreed that the Massachusetts Division of Air <br />Quality Control (DAQC) Policy 90-011, which is cited in the Lexington Noise By- <br />Law and which is still in effect, provides the preferred method of ensuring a noise- <br />friendly environment in Lexington. Therefore, the NAC agreed that this provision of <br />the By-law not be changed. <br />??J. Bussgang suggested a review of the special permit application form, and that the <br />committee revisit the hours specified in the By-law when certain activities will be <br />permitted (such as early morning lawn mowing, etc). J. Bussgang also suggested that <br />the police be asked if, in their experience, the noise bylaw is easy to enforce. How <br />often is enforcement required for our bylaw? Who enforces, the police or the board of <br />health? Are the police the only ones who know how to use the noise meter? T. <br />Galaitsis will check on the status of the sound level meter, who is using it, and how <br />many complaints have they had? <br />??Committee recommends that on the item H of the current By-law, regarding domestic <br />mechanical equipment, should be changed from 9 pm to 8 am (from current 9 pm to 7 <br />am) for weekdays and weekends. Question: Do landscapers need a permit? M. Wood <br />will ask the town clerk about this. Trash collection page 8 of the current By-law, <br />should be changed to no trash pick up between 10 pm and 7 am. And the same date <br />should apply for deliveries. J. Maloney will check with the Chamber of Commerce <br />on this to get their feedback. <br />??Reminder for T. Galaitsis: Ask J. Krieger about construction equipment. Another <br />meeting will be held to discuss possible revisions to the special permitting form. T. <br />Galaitsis will check with Police on a variety of issues (referenced above). <br /> <br />2. NAC Membership <br />The Board of Health (BOH) representative has resigned. Since the BOH needs to be <br />represented on the NAC, T. Galaitsis will ask BOH to appoint a new representative. <br /> <br />The next meeting will be on 7 October 2008. <br />The meeting was adjourned at 8:55 pm. <br /> <br /> <br /> <br />1 <br />
