Lexington Board of Health, February 23, 2005, Meeting Minutes

The meeting began at 7:05 PM. There was no public participation.
An election for a new Chairperson took place. Perlmutter motioned to appoint Heiger-Bernays
as Chairperson. MacKenzie seconded. All approved.
Heiger-Bernays asked the Board to review the minutes of January 13, 2005. Perlmutter
motioned to accept the minutes as amended. MacKenzie seconded. All approved.
Fullerton opened the hearing on the Grease Trap Regulations. He explained the reasons why
grease traps are needed in food establishments. Andrew Riffin of 6 Field Road, Lexington spoke
to the Board concerning the use of enzymes to clean the grease traps. After a considerable
discussion, Perlmutter motioned to accept the grease trap regulations as written and adopted and
amend if further information warrants the need. MacKenzie seconded. All approved.
Fullerton began a discussion concerning Part I of the Emergency Dispensing Site Plan. Fullerton
had met with the Police and Fire Chiefs to identify appropriate vaccine dispensing sites if the
need arises. The sites are: Lexington High School, Bowman School and Estabrook. Mutual aid
agreements for the sites are being developed by Regional BOH Committee.
Fullerton began a discussion about the proposed Battlegreen Inn redevelopment. Eric Shapiro,
owner of the Battlegreen Inn is proposing to demolish the existing structure and rebuild a three
level structure from ground up. Previously, a leak from a 5,000 gallon underground oil tank was
identified within the Battlegreen Inn property and lead to contamination of groundwater in the
surrounding area. Case has not been closed with Department of Environmental Protection
(DEP). Perlmutter asked if we or DEP could insist on the cleanup. Heiger-Bernays stated the
Board of Health could require soil testing for indoor air quality. Fullerton will notify the site
owner, Eric Shapiro, of the Board’s concerns with a copy to the Planning Department.
Fullerton addressed the Board of the possibility of creating mercury regulations at the suggestion
of Pat Scanlon of Wheelabrator. Fullerton explained to the Board that if adopted, contractors
would be required to comply at the time of demolition. Copies of the Town of Northbridge’s and
North Reading’s mercury disposal regulations were provided for informational purposes. The
Board would like to see other town’s regulations and discuss at a later meeting.
Fullerton then began a discussion concerning the housing violations at 50 Rindge Avenue. Fox
and Fullerton inspected the property recently and found all violations corrected and in
compliance.
A discussion began concerning Article 40 Ad Hoc. An article was to appear in the
LEXINGTON MINUTEMAN to establish the idling problem. A survey will be conducted
Prior to the education campaign and after to evaluate if key community education on idling has
been effective.
Fullerton began a discussion of the Director’s Report. Heiger-Bernays asked how Fullerton’s
time will be allotted to achieve these goals. She also asked for a breakout of routine daily core
items. Heiger-Bernays also feels the Health Agent should have an R.S. certification no later than
December 2005.
MacKenzie asked to revisit Title V for the next meeting. Fullerton is to research the Title V
software to track required pumping.
Perlmutter moved to adjourn at 9:05 p.m. MacKenzie seconded. All approved.
