PLANNING BOARD MINUTES MEETING OF APRIL 4, 2007 A regular meeting of the Lexington Planning Board, was held in Room G-1, Town Office Building, and called to order at 6:35 p.m. by Chairman Manz with members Zurlo, Hornig and planning staff McCall- Taylor, Henry and Kaufman present. Mr. Canale arrived at 6:40 p.m. and Mr. Galaitsis arrived at 6:45 p.m. *********************** ARTICLES FOR 2007 TOWN MEETING************************** Article 4, Inclusionary Housing: There was a discussion by the Board about reconsideration of the Inclusionary Housing Bylaw, with changes recommended by some Town Meeting members, i.e., raising the threshold from five housing units to nine and giving the Planning Board discretion regarding location of affordable units on additional sites. Mr. Hornig said, based on what he heard, there was little support for the Inclusionary Housing Bylaw in any form. Since the Town of Lexington is above the 40B ten percent mandate there seems to be no interest in pursing this any further, and clearly there are no changes that would change the consensus of the Town at this time. Ms. Manz said Town Meeting members stated they were opposed due to a lack of fairness, but as each such issue was addressed new concerns would be made known. Mr. Zurlo said that the Board should consider the Town Meeting Members recommendations because it would be best to get the bylaw passed, and amend it as needed rather than bring back a new bylaw in the future. He also suggested the Board could consider a bylaw which was cost neutral to the developer. Mr. Hornig said Section 49 allows for the option of getting a density bonus in return for providing affordable units. Mr. Zurlo stated that it was not mandatory. It was decided that the Board would not make a motion for reconsideration and they would only address reconsideration if others brought it up at Town Meeting. Article 5, Tree Management: Ms. McCall-Taylor advised the Board that there may be an issue with the last sentence in the bylaw and wanted the Board to be prepared to address this matter if raised at Town Meeting.
