Smith, Nyles N. Barnert, John J. McWeeney, <br /> Judith J. Uhrig and Carolyn C. Wilson <br /> Staff present: Dianne Cornaro, Administrative Clerk and David George, Zoning Administrator <br /> Petition Address: 33 Skyview Road, Map and Lot: 0090000081 <br /> The relief sought is for a Variance in accordance with section 135 -35 (Table 2 of the <br /> Dimensional Constrols) of the Zoning Bylaw to allow a side yard set back of 6.3 feet instead of <br /> the required 7.5 -feet side yard set back.. <br /> The Chairman opened the hearing at 7:45 PM by reading the legal notices and described <br /> information received from the petitioner relative to the petitions. <br /> Prior to the hearing, the petition and supporting data were reviewed by the Building <br /> Commissioner, Conservation Administrator, Town Engineer, Health Agent, Board of Selectmen, <br /> Zoning Administrator, Planning Board and the Historic District Commission. Comments were <br /> received from the Building Commissioner and the Zoning Administrator. <br /> Jennifer Schwartz, owner of the property, presented the petition. The applicant seeks to <br /> construct a 2 -story addition on an existing foundation. The lot is non - conforming and the <br /> structure placement limits what can be done to the existing home. <br /> In 1999 the petitioner was issued a town approved permit to build a full foundation and a deck <br /> with a side yard setback of 6 ft 3 inches. They are currently trying to obtain a building permit to <br /> construct on top of the existing foundation and move the existing deck. <br /> One of the Board members asked to clarify why the deck needs to be extended. <br /> There were no questions from the audience. <br /> No one spoke in favor of the petition. <br /> No one spoke in opposition of the petition. <br /> The Chairman closed the hearing at 7:49 pm. <br />
