Barnert, John J. McWeeney, Judith J. Uhrig and Carolyn C. Wilson Staff present: Dianne Cornaro, Administrative Clerk and David George, Zoning Administrator Petition Address: 33 Skyview Road, Map and Lot: 0090000081 The relief sought is for a Variance in accordance with section 135 -35 (Table 2 of the Dimensional Constrols) of the Zoning Bylaw to allow a side yard set back of 6.3 feet instead of the required 7.5 -feet side yard set back.. The Chairman opened the hearing at 7:45 PM by reading the legal notices and described information received from the petitioner relative to the petitions. Prior to the hearing, the petition and supporting data were reviewed by the Building Commissioner, Conservation Administrator, Town Engineer, Health Agent, Board of Selectmen, Zoning Administrator, Planning Board and the Historic District Commission. Comments were received from the Building Commissioner and the Zoning Administrator. Jennifer Schwartz, owner of the property, presented the petition. The applicant seeks to construct a 2 -story addition on an existing foundation. The lot is non - conforming and the structure placement limits what can be done to the existing home. In 1999 the petitioner was issued a town approved permit to build a full foundation and a deck with a side yard setback of 6 ft 3 inches. They are currently trying to obtain a building permit to construct on top of the existing foundation and move the existing deck. One of the Board members asked to clarify why the deck needs to be extended. There were no questions from the audience. No one spoke in favor of the petition. No one spoke in opposition of the petition. The Chairman closed the hearing at 7:49 pm.
