Minutes of the Lexington Zoning Board of Appeals — January 13, 2005 <br /> Present: Acting Chair,. Arthur Smith, Nyles Barnert, Maura Sheehan, John McWeeney and Associate <br /> John Gilbert sitting in for Judith Uhrig. <br /> Petition Address: 18 Hickory Street <br /> The Chairman opened the hearing at 7:45 PM by reading the legal notice and described information <br /> received from the Petitioner, other Boards and Commissions relative to the Petition. There were 5 <br /> letters of support submitted with the petition. <br /> Subhash C. Gupta, owner of the property, presented the Petition. <br /> The relief sought is for a Variance in accordance with Zoning By -law section 135 -35 to allow relief <br /> from front and side set backs. <br /> The hardship is with the placement of the house on the lot a variance is needed for proposed additions. <br /> Questions from the Board: <br /> Mrs. Sheehan: Are there wetlands in the back? Answer: Not usually any standing water. A little wet <br /> right now with weather as it's been. <br /> Questions from the audience: None <br /> Speakers in favor — Mr. Ron Gold, abutter was present and in favor of the project saying that he would <br /> be the neighbor most effected by project. He thought that Mr. Gupta's addition would be very tasteful <br /> and would be an enhancement to neighborhood. <br /> Speakers opposed: None <br /> Hearing was closed at: 7:53 pm <br /> Decision: On a Motion by Mr. Nyles Barnert and seconded by Mr. John Gilbert, the Board by vote of 5- <br /> 0, granted the variance to allow a 24'6" front setback and a 10' /z foot side setback at 18 Hickory Street. <br /> Submitted by Dianne Cornaro, Clerk <br />
