Minutes of the Lexington Zoning Board of Appeals June 8, 2006 <br /> Present: Chairman — Judith J. Uhrig, Nyles Barnert, Maura L. Sheehan, Arthur C. Smith and <br /> Associate Carolyn C. Wilson <br /> Petition Address: 354 Waltham Street <br /> The relief sought is for a Variance from Section 135 -35, Table 2, Dimensional Control to allow <br /> side set back of 8.6 feet rather than the required 15- feet. <br /> The Chairman re- opened the hearing continued from May 25, 2006. Due to an error in <br /> advertising the amount of footage needed for the Variance abutters were sent new abutter cards <br /> with the correct set back information needed. <br /> The Board had received an elevation showing the desired construction. The applicant was not <br /> present and the Board voted to proceed with the hearing. <br /> There were no questions or comments in favor or against. <br /> The Board believes that the shape of the lot and the placement of the building create a hardship <br /> which justifies the requested variance. <br /> On a motion by Nyles Barnert, seconded by Maura Sheehan, the Board voted unanimously to <br /> grant a variance allowing a side -yard setback of 8.6 feet. <br />
